My employer sent me to a location in the US for several months, where I am required by agreement to stay until I am released to leave by the contractee. Those of us who are here were promised a certain minimum number of hours per week as inventive to go to whatever site we were sent to. We got to our location, and were immediately informed upon arrival that we will only get whatever hours they decide we need to work. We should get 40 hours a week, but that is considerably less than we were told we'd get. I'll actually make less here than at my "home" station based on this little maneuver of theirs, and I can't leave to go see my family or anything else. I'm so pissed right now, I can hardly see straight. And I'm not the only one.

[Bang][Bang][Bang][Bang][Bang]

Just had to get that out. Now, for the inevitable [BooHoo]......[ROFL1]

As much as that fricken blows, 40hrs is much better than 0hrs.

Trouble, sorry to hear that man... Did you sign a contract/etc in writing saying you would work x number of hours? If not, not much can be done.

I've been burned like that before. Man does it suck...

That's total BS! I had a contractee try that crap when I worked for that three lettered, blue logo, corporation 20 years ago. It's an old ploy that demands retaliation. In my case, they soon discovered that the fewer hours that were allotted... the less that actually got completed. I say activate the "ID-TEN-T" alert with your base employer and feign brain damage until this is corrected!

In the mean time move from warp speed to sublight.... Get a helmet, your pass for the short bus and move at 30-50% of rated capacity.

If that fails, "cry, 'Havoc!' and let slip the dogs of war!!!" by implementing a "scorched earth" campaign of retribution by digital reputation besmirchment & character assassination from multiple annonymous internet vectors. And then Complain... LOUDLY & OFTEN & AT INCONVENIENT TIMES... Might just cause them to release you to allow you to seek greener pastures.

After all... they probably hired y'all because they do not possess the quality of resources to intercept & nullify someone with your skillset, no? [Stick]

Is this going too far? Naw... they earned it!!

Excellent post and advice to Trouble.

Good Luck Trouble. I have sat at electrical yards for a couple weeks watching the paint dry when they wouldnt let us work for some BS reason after another. We finally after making the company pay us for 3 weeks of doing nothing, flew home with the stipulation of calling us back to the yard when they were ready to deenegize surrounding equipment and allow crane ops to take place. They learned a valuable lesson, because we billed them full freaking rates. They never did that to us again and we still have a lot of work with that company to this day.

If you've got that promise of at least 40hrs per week in writing, I'd start mumbling "Breach of Contract lawsuit" when ever you call the home office. That usually get someone's attention.

Yes do this if you hate working 40 a week and want to be on unemployment. [Stooge]

Fixed it. Because then you could add wrongful termination to the lawsuit. Of course this all depends on the contract he was hired under, but it's bullshit and it should be fought. [AR15]

There's plenty of contractors out there, he can always find a better one. I work with a Booze Allen guy and they never seem to be short of work.

What's in writing that they signed and you signed? Since you've got so much free time might want to take a look and wtf you can nail them with.

this. there is a lady suing wal-mart over being overcharged .02 cents. penny for your thoughts, but getting overcharged .02 cents could be worth tens or hundreds of thousands of dollars.

Find the contract, find where it said what kind of hours you were promised. don't let them get away with shit.

worst case, get fired and then you really have a lawsuit.

In colorado a employer can fire you for any reason cept for race, age, special needs and the like. right?

BigBear
10-03-2011, 13:35
Yes, Colorado is an "at-will" employment state. Simply put they can fire you pretty much anything. That is why it is very important to get a written contract when in a new job. Then you have the burden of proof when getting involved.

If they promised you 80hrs in writing but you barely clear 30 because they send you home early. You do have case precedent for a lawsuit.

They can fire you for any reason, with out giving a reason. It could be race, sexual orientation, disabilities or any other thing prevented by law.. because they do NOT have to give you a reason. Yes, it does happen.

That being said, you are also free to resign your employment 'at-will'. Nothing keeping you there.

Check your paper work and see if there is an hour guarantee, then look at it again to see if there is a disclaimer/rider stating that it's possible to not happen. As a contract employee you lack certain protections that a 'full-time' employee would have.

We're not contract employees, we're regular employees of the company who contracts. But the at-will info is correct, although we're guaranteed 40 hours a week. We've managed to get things improved over what we were told when we arrived, so it's better than it could have been. I think from what I've found out is that we're paying for another part of the company getting caught pulling a fast one. Our contract is fairly important for the company, and high visibility to the customer so they don't want to lose it and right now due to the requirements they have to hire people into our program we're hurting for people and we can't afford to lose any; if we do start losing people due to this they're going to have to do something quick.

None of this means anything, however. I'm going to see how things pan out, and go from there. I still have other options, at least one of which would bring me back to Denver. So, we'll see.

Sorry to hear about your situation, Byte. Hope you get it straightened out soon.

And no, I'm not in Clovis for this. I've spent some evenings having dinner in Cook's though. Sometimes when we get time to eat it's all that's open!

If you do get back in this neck of the woods, let me know and we'll go play with some tannerite.
