The 'insanity' plea is such a joke. Like you said, is there ever a person that goes and shoots up a bunch of unarmed people that is sane? There is insane, and apparently 'sane and just evil'? What distinguishes the two?

It blows me away that such a defense even exists and is accepted.

The only difference between sentencing for sane or insane, in my opinion, is whether you spend the full sentence in a padded room or in general population.

lived with me and some roomies bout 10 years ago ...

the plea is not bullshit ... the kid had some pretty major issues.

Seriously though, in reading some of the reports he did have some serious demons in his mind and I do see where the insanity plea has it's merit.
If the person is incapable of coherent thought processes how can they fully understand the process they are going through?
Not to mention it allows the individual to obtain counseling and possible help.
If they don't understand what they did was wrong how can they be expected to show any remorse or accountabilityfor their actions?
Our justice system has it's good and bad.
But it is still the best system around IMHO.

I'm not doubting that he's crazy, or a lot of other people that use that defense. My brother was paranoid schtizo, and heard and saw things all the time.

But not guilty because of it? That's what I have a problem with. Even though people that use that defense get treatment, and sometimes the treatment helps them, I don't think that they shouldn't be punished for the crime.

I propose a new verdict option: Guilty AND insane. Sentencing would be the same as a regular guilty verdict, but with the convict sent to a secure mental health facility. Upon the assessment of a psychiatrist that the convict is "sane" they would be transferred to a regular prison for the remainder of their sentence. If they were never pronounced "sane" they would continue to be held in the loony bin.

No That just explains my problems not his... LOL .. is it so bad every time I hear that electric 60hz humm I twitch ???


Bo really did have problems... thats kinda why he ended up living with us.. had no where else to go .. his older sister was dating one of the roomies so we took him in. He would be ok for the most part unless he forgot or ran out of meds.

I dunno how long they would have given him with just a plain guilty... but I'm sure he is gonna spend quite some time in a rubber room getting care.

Thats the thing about the insanity plea-He can now be kept in the rubber room indefinitley.
If he is ever found competent to stand trial than he shall do so.

The one positive of the situation(shooting) is it was not worse than it could have been.

Like I used to tell my Mother when I was caught doing something bad, "Mom, I didn't mean to do it". As if that was to make everything better.

your right claim....

it does not make it better.. but thank god Bo didn't kill anyone.

Frankly with his issues general society is probably better severed with him spending X amount of time in the hospital then in a prison that will kick him out better or not ( and frankly probably much worse off then when he started) in a few years when he "kills his number".

The kid needs help .. it sucks that to finally really truly get the help he needs he had to hurt some innocent folk first. I wish I coulda seen this years ago and helped him more myself.
