View Full Version : Prior to obtaining CCW, the CBI background check.. info?

Ive tried to find what they actually look for, and have been unsuccessful. I have cleared a federal background check well enough to have a govt job, but im wondering how far they might go back... there may be a case way back in the days of sewing my oats where i might have done something that wasnt quite on the right side of the law.
SO, if you know, #1 how far do they go back? #2 what might exclude yourself from obtaining a CCW?

They go back to the beginning.
They may question any “arrest” which carries a certain penalty.
Even if you were not convicted.
Along with Federal offenses, domestic violence, etc.

So is there any rule about what hinders your obtaining the permit? I mean besides the usual felonies, sexual assault, domestic violence, that type of stuff.

To the best of my knowledge, they just do a NCIC check and see if anything pops up. If you have never been arrested no problem. If you have then I would guess it goes to someones desk who looks it over and decides if you are a danger to the public at large.

They look for any felony conviction, any arrest for domestic violence, any arrest for drug and alcohol related offenses, any arrest that resulted in a commitment order, or any restraining order.
ANY felony conviction stops you.
ANY arrest for domestic violence stops you (convition is not needed).
Arrests for drug and alcohol related offenses may be used to determine that you are an unlawful user of drugs or addicted to drugs or alcohol. 2 or more are needed.
ANY arrest that resulted in you being committed to any mental facility against your will, will stop you.
ANY restraining order against you will stop you.

Here is a quick question.
I am under the assumption that they only check the state of colorado and then the federal background check.
Is it possible that someone could of done something in another state and it isn't recorded at the federal level?

That depends on what the "something" was and how long ago. If it was a felony, NO! If it was a misdameanor Domestic Violence or a Drug Trafficking type charge and has been since this law was passed, again NO! If it was a petty offense, traffic offense, a misdameanor with no conviction and was fairly old or when you were a minor, then maybe.
Have you bought a gun recently from an FFL holder? Was it here in Colorado? If so, then you passed the Insta-Check and will most likely pass the same check for the CCW. Karl.
