Thats why I bought the Ruger lcp 380, and had no problems. It shoots any type 380 round I put into it. Dam that sucks though. Take it back to the dealer you bought it from, wont they work with you?

Rarely will a dealer "return" a firearm but it does not hurt to ask respectfully. If not don't make a big deal about it if they won't.
1- The dealer did not manufacture the firearm.
2- You may need them in your corner so to speak, don't burn a bridge with them.
Generally a manufacturer will accept a shipment directly from a customer for warranty/repair purposes. Return shipping to the end user(you) is usually acceptable. The only thing that may change this is the fact of a handgun in this instance. Not 100% sure. Contact Smith & Wesson.
Taurus is a notable exception, all returns must be done through a dealer.
You purchased a firearm brand new from a dealer expecting a functioning firearm. You paid for the factory warranty, get what you paid for.
Contact them via email immediately. Be concise, describe the issue and articulate that you are very dissatisfied but be respectful. Don't rant and rave, keep it professional. Keep a copy of the e mail, that way you have documentation. Follow up with a respectful phone call Monday morning.
Then we can address the area of concern you PM'd me about.
Bummer deal-you have every right to be pissed but S&W will stand behind their product.
Before you cry yourself a river, give Smith and Wesson a call. They'll take care of you.
just kinda pissed at myself for giving it to my wife to carry before i test fired it
Ahh, I see. Any time I've had an issue with a Smith, I've just called them and they were great about helping me out. Usually for free. I haven't paid for anything acturally.

I have read of a few cases of firearms getting to customers missing a firing pin, which sounds like your problem, no dent in primers, but those incedents were with used firearms resold by a dealer that just put them in the show case without checking them out.
Does this model have a firing pin block that may not be moving when you pull the trigger ?
Anyway, if this is a new sales, call S & W first thing Monday, they should be very helpful. E- mailing will only cause delays in getting the problem solved to your satisfaction. Dang, every time I type or say that word I hear the Stones singinging that song... I can't get no...[Tooth]

I just went through this with Sig a couple weeks ago with a P238. They gave me a UPS label I let the dealer hand it off the the driver to save me a trip to the UPS distro center and a headache, and they fedexed it to my door, so the handgun issue shouldn't be an issue.
Agree with BigNick. They will return to your home with signature required. The only time I have had to go through an ffl was when Ruger could not fix the problem and had to send a new firearm. I've also heard of trigger breakage and slides flying toward the target (gives new meaning to throwing the gun at the bad guy) with the Bodyguard. Having said that, S&W customer service does a good job of standing behind their product.
is there a exploded diagram of one of these online anywhere i searched but couldnt find one.....
because i am not the original owner sw is NOT going to warranty the repair.....i REFUSE to send it in to them and then PAY them to fix a brand new gun.......bp you have a pm....
Will it not shoot the first chambered round? or does this only happen after the first round is fired?

Smith will take care of you and it shouldn't cost you a dime.
My Bodyguard .380 was great out of the box and still is. However, the laser failed after about 100 rounds. That same day I had a printable full postage paid label to return the whole gun. I felt it a waste and told them I'd be happy to remove just the laser and send it via a much cheaper method. They said "kool" and resent a cheaper label. I just couldn't see them having to lose all of their profit and then some because of such a simple thing (yeah, I'm that guy).
This has kind of been my experience with any gun I had a problem with. Kahr was just as good. Glock replaced all 6 of my G23 mags because I called them with a question about backwards compatibility of the different generation mags.
You'll be fine.
