Well, this could get interesting...
Looks like our friends at the BATFE could be looking into banning "military style" shotguns. But, they are taking opinions from the public! Yeah, right...

I don't see how the ATF can "ban" anything. The don't/can't make legislation, they simply enforce it.

What they did with the USAS 12 and the street sweeper was to declare them destructive devices. Im not sure but I think their authority to do so stems from the 68 GCA and that it is over .50 bore diameter. Destructive device means paperwork and tax stamp. Many thought the development of drums for the saiga would lead to a similar fate for the saiga. It will be interesting if they declare the saiga a DD, their are a LOT more of them out there than the previous two. If they are indeed moving in this direction, its interesting that they sat on it all this time, and are moving now before the election.

Quite frankly I have not heard of too many bad guys out there using Sagia shotguns to commit crimes so what is the motivation? I LOVE my Sagias, but my 930 Spx is just as bass$$ and would be more mobile and efficient to be used in crime. Seems to me its the 1994 look at we can do ban talk all over. Man the 20 round drum is evil, man that flash suppressor is evil, hollow point bullets are evil blah blah.

Thats the million dollar(hypothetical) question.Every firearm that has been declared DD in the past has not been grandfathered. On the other hand with as many saigas out there as their are not grandfathering presents a paperwork and enforcement nightmare. My completely wild ass hypothetical guess- not grandfathered in.

The best part is the lack of reading comprehension by so many people. The key word is "importability" - Can we IMPORT these shotguns from outside the U.S.? Won't affect Mossberg, Remington, FNH USA, or any shotgun manufactured here.

Dudley and all the commenters skipped that word and read it as a total ban on "tactical" shotguns. Old news - NRA has been fighting this battle for a while (or at least telling me in my magazine that they're fighting it).

ATF has the administrative authority to determine what is and is not importable when it comes to firearms. They also have the authority to determine whether or not a firearm with a bore over .500" meets the NFA destructive device exemption criteria for a sporting shotgun.

ATF can and has ruled some shotguns, even those domestically-made, to be destructive devices - such as the USAS-12 and Streetsweeper about ten years ago.

The procedure ATF is supposed to follow is to allow existing owners to register them free of charge, and without the need for a LEO signoff, for some period. In the case of the streetsweepers, owners had a year to register them, and after that if not registered they become contraband. New purchases have to go through a Form 4, get a $200 stamp, and if an individual, get LEO signoff.

If you happen to live somewhere that doesn't allow destructive devices, however, ATF will not accept your registration, and you'll need to get rid of the thing to a friendlier state or something.

Maybe not saiga's but instead they are scared of these newer albeit rare shotties. The 15 round space shot gun or KSG. The 16 round rotary magazine semi auto SRM 1216? The currently small mag but some potential UTS12 ar15 lookalike 12g?

This is the exact same crap as last year. The "recent" article they mention is from April 2011.

The ATF decided to take no action on it after overwhelming public opinion in support of shotgun ownership.

That for all intents and purposes ATF does what they want, they create and enforce vague policies without regard to constitutional or legislative concerns, and have been doing so for as long as there has been an ATF.

There's a lot of people out there who "can't" do something that all of a sudden seem to have an awful lot of authority.
I agree that we've heard this song/dance before, but I also believe that it's only a matter of time before they attempt to take a bite out of something really big- if nothing else only to see what kind of a fight they encounter...
