ETA: I'm curious too. I pick my kids up every day and sometimes I'm out and about before going to the school and I'm packin. I just make sure it's out of sight when there.

Yes. You can keep it on you as long as you don't exit the vehicle. If you DO exit the vehicle, it needs to be in a container, i.e. you can't just leave it unsecured on the dash board or under the seat or something.

I didn't like disarming in the parking lot, so I would usually unholster and toss it into the glove box while I was up the street, then lock the glove box when I got out.

Prior to retiring I worked on several school construction sites. If my memory is still holding, in addition to being secured, I think a firearm has to be unloaded. In my Dodge Ram, I had a lockable console insert. Prior to getting anywhere near a school site, I would unholster, unload and lock it away. I always figured it wasn't worth taking any chances.

No, it doesn't have to be unloaded. Like Irving said, it's legal as long as you remain in the car. The statute states that if you get out of the car the gun must be placed inside a compartment within the car and the car must be locked.

I think if you have a CHP, you can. If not, the Federal law kicks in - and it's a big no-no.

You can have it in your car. I am not 100% sure on the locked part but it can be in your car.

Text of the federal law says it doesn't apply to a firearm...

"(iii) that is— (I) not loaded; and (II) in a locked container, or a locked firearms rack that is on a motor vehicle;"

So loaded is OK w/CHP if you're in the vehicle OR in a container in a locked vehicle if you're not.

At least that's the way my non-lawyer brain is interpreting it.

Statute doesn't say anything about unloading.

This applies on K-12 property only. I attend PPCC and if you have a valid CCW permit, you can carry concealed on campus.....and I DO.

Interestingly enough I brought this up with the DA's Office because 18-12-105.5 says not illegal if the person leaves the weapon locked in the car and the person has a valid permit.

I submit to you this. If it is legal all the time to have a loaded firearm in your car without a permit and it is illegal all the time to carry a firearm on school grounds with a permit, why does the permit even come into play for this situation? Shouldn't the regular law apply and anyone that has a loaded firearm locked in their vehicle be left alone, whether a permit is presented or not?

The DA told me that they would most likely not touch this as a case if the person was an adult and legal to have the weapon and isn't in violation of school policy etc. I was told it was way too contradictory to mess with.

And I would say this is another good reason to get your conceal carry permit. Protected that much more...less worry.
