Can't post a link from the phone but Issa filed a 41 page Civil Contempt lawsuit demanding:
1-Obamas "Executive Privilege" be found invalid.
2-Holder produce all documents pertaining to F&F.
3-Holders objection to the House records subpoena be rejected.
The Blaze has a good article including the entire 41 page complaint.
Can a court find the exercise of "executive privlege" by a sitting president to be invalid or otherwise "unlawfully" implemented? I honestly don't know.

Did a Democratic majority Congress try to do so in the last Administration? If so, I don't remember hearing about any success.

"Sec. 3. Claim of Executive Privilege by Incumbent President.
(a) Upon receipt of a notice of intent to disclose Presidential records, the Attorney General (directly or through the Assistant Attorney General for the Office of Legal Counsel) and the Counsel to the President shall review as they deem appropriate the records covered by the notice and consult with each other, the Archivist, and such other executive agencies as they deem appropriate concerning whether invocation of executive privilege is justified.
(b) The Attorney General and the Counsel to the President, in the exercise of their discretion and after appropriate review and consultation under subsection (a) of this section, may jointly determine that invocation of executive privilege is not justified. The Archivist shall be notified promptly of any such determination.
(c) If either the Attorney General or the Counsel to the President believes that the circumstances justify invocation of executive privilege, the issue shall be presented to the President by the Counsel to the President and the Attorney General.
(d) If the President decides to invoke executive privilege, the Counsel to the President shall notify the former President, the Archivist, and the Attorney General in writing of the claim of privilege and the specific Presidential records to which it relates. After receiving such notice, the Archivist shall not disclose the privileged records unless directed to do so by an incumbent President or by a final court order"

....from what I can recall, yes. the bush admin executed an Executive Privilege, but courts overturned it and they were forced to release the info.....
in the end the Executive Privilege just prolongs the process of getting the docs released, it doesn't work and makes it worse.....(i have been wrong before though)

Yes, there is case law that says that a president cannot invoke executive privilege for everything. Understanding that some matters are sensative to safety and national security but other matters the people have a right to know. I will look up the case on it, it has been a while. When I find it I will post it.
