I don't know if these guys were legally carrying, but holy crap did they let this get out of hand. If they are CCW holders it will make us look real bad.

NORFOLK, Va. (WAVY) - Norfolk Police have released new information on a deadly shooting inside a local pharmacy Thursday afternoon.
Karen Parker-Chesson with the Norfolk Police Department said officers first received the call for a shooting inside the Rite Aid located in the 3600 block of Tidewater Drive at 2:05 p.m. Wednesday, officers released information that two men got into an argument inside the store and shot each other.
One of the men died.
Parker-Chesson has identified the victim as Ramon P. Colorado, Jr., 42, of Norfolk. Colorado was an outspoken Norfolk citizen who owned the Facebook page “Norfolk Dirt.” (http://www.facebook.com/NorfolkDirt) He described the page as “news for the common people.”
Colorado also frequented local protests and events held by activists and videotaped his experiences (http://www.youtube.com/user/NorfolkDirtVideo) .
According to police, Colorado approached the pharmacy counter in the Rite Aid and stood behind a customer. The suspect, identified as Bernell Duvall Benn, 41, of Norfolk was talking on a cell phone and accused Colorado of jumping ahead in line.
Both Colorado and Benn exchanged words, at which time Colorado sprayed Benn with pepper spray, Parker-Chesson said.
Benn then allegedly drew a handgun and fired it at Colorado. Colorado drew his own gun and returned fire, Parker-Chesson added. Both suffered gunshot wounds and were transported to Sentara Norfolk General Hospital.
Colorado, who suffered life-threatening injuries, was pronounced dead at the hospital. Benn suffered non-life threatening injuries and was treated and released.
Benn has been charged with murder and use of a firearm in the commission of a felony. He is being held without bond. WAVY.com found Benn's criminal record includes misdemeanor disorderly conduct and traffic violations.

So the dude that got sprayed with pepper spray killed the guy that sprayed him, the sprayer only wounded the sprayee... Hmm.

Why was the guy who was sprayed charged I wonder? If you get sprayed you can't defend yourself as in pull your firearm? I mean the guy was armed, being aggressive by spraying him or is it because the other guy initiated it?
Let's play Defense/ prosecutor......

In most places getting pepper sprayed would not be reason enough to pull a gun and shoot. At least not if you didn't see the gun first. For outside the home defense it requires the immediate threat of serious bodily injury or death. Usually pepper spray is used to avoid either of those.

Lots of criminals use mace/ pepper spray to disable their victim, prior to assaulting them. I believe the guys past "record" was weighed against him. I'm concerned the misdemeanor charges might be a cause for denial in VA.

O yea! I don't think that is a good validity to the situation.
1. Someone pepper sprays me; I am not gonna stand around and wait for what might be coming next. Especially if it is just because I am calling someone out for cutting.

This is validation for everyone who accuses people of walking around with video cameras of purposely looking for trouble. This guy sure found trouble, and didn't survive.

Colorado cuts in line, Benn calls him on it, argument starts, Colorado sprays Benn, Benn draws first, both pull guns and shoot, both wounded, Colorado dies at hospital, Benn released from hospital and is arrested and charged.

Depending on the details of witness accounts, this could go either way for Benn. I can see a scenario where its a good shoot and scenario where its a bad shoot.
Bizarre.
Can't even cut in line anymore without getting shot.

Benn's explanation sounds believable to me but not much to go on at this point.
"After he noticed another man had gotten in line in front him, Benn said he told the other man, "Excuse me, sir. I'm in line."
After the man became hostile, Benn said, "I moved out of the way and let him have the spot."
Benn said he continued talking to his mother when he was hit by pepper spray and heard the other man say, "I got more for you, bro."
After both men had drawn weapons, Benn said, he asked Colorado to put his gun down.
"I was scared for my life."
He was shot in the back and showed bandages covering the wound. After shooting Colorado, Benn said, he kicked Colorado's gun away to stop him from retrieving it."

After watching the interview it seems that maybe because he was able to get away then went back, this is why he is charged. Seems from him interview he was able to escape the attack, drew his gun then returned????
Of course did he have to continue to try and escape?
Interesting to see how it plays out... i say charges are dropped, anyone else?

Interesting. He went back. If he claims that he thought the guy was deranged and going on a shooting spree and that's why he went back, maybe he'd get off. Doubtful though.
This shit is a downright embarrassment to gun owners

Not sure it can be said; he went back but in the interview he said he was sitting in an isle away from the guy and the guy kept saying were are you, I have some more for you. He said he pulled his gun then looked around the corner to see Colorado had drew what his.??
Guess we need some witness accounts to know the full story...
