View Full Version : High Cap Mag law in CO

So I had some loaded 30 round mags while walking into a outdoor range right on Aurora and Denver border zone. A cop/ATF officer guy pointed them out and said i can't have them. I insist to enter the range and said that is incorrect for the area i'm at, but he wrote me a ticket and seized my mags.
This piss me off. I'm pretty sure the ground i was standing is not part of City of Denver. I need to talk to someone about this crap and get my stuff back. I was holding the mags in my hand though, that may be the only possible mistake on my part.
You need to make sure you were not in Denver first...

What range was it?

That sounds hinky as hell, but its the city AND county of denver, as one entity....
...so, if you were in denver county, your in the city, so far as right of law is concerned. The county lines tend to follow water resources, so its kinda hard to tell. Cherry Creek, to be clear, is in denver.
There is a ban on mags over 20rnd capacity, but the law is poorly written and unclear. I would appear on the ticket and indicate that you were going to a shooting center you did not believe was in denver, and would not knowingly violate the law. However city demarcations are not clearly marked, and a home rule law that contradicts the legality for the rest of the state is difficult to follow where not posted.
Not knowing the particulars, i can only suggest, of course, since this is the first time EVER that I have heard of someone sited under that law in exclusion of any other violation.
Its curious you identified an "cop/ATF guy"... ATF, does not have that jurisdiction, and the home rule ban is a matter internal to denver. So who exactly did this person work for?
The Cherry creek range is not in Denver City or County. County line breaks to the north at 225 and to the east at Yosemite.

I think I'd figure out exactly what agency this "Officer guy" is with (should be able to figure that out from the ticket), and then find out exactly where the range is located, city/county-wise. Then go from there.

The way I read the law (and the way it's explained on the RMGO website) is that it's OK to possess either the gun or the over-21 round mags, but not both together.
Something just isn't adding up with the OP.

The guy was a officer of Denver police. I always thought the Cherry Creek State Park is part of Arapahoe County, maybe i was wrong, maybe they got a new regulation.
I always know it's a bad idea to have a mag over 20 round in Denver, the suburb south of Denver is frequented by Denver PD a lot, not sure if they have jurisdiction there.

CC Range is in Arapahoe County. I have been their many times with 30rd mags. I think you may just have run into a rookie or a "duddly-do-right". Bummer, hope you get em back.

Cherry Creek Family Shooting Center is in Arapahoe county. See the map in my earlier post. Just because they may patrol that area doesn't mean you have to follow their libtard laws outside their jurisdiction.

For the record, It IS a fine line. Denver owns the water, so a lot of the park is in Denver county (check a map)...
..But, it is legal to transport mags through denver, as long as not in a weapon in ready condition (IE, loaded rifle in car)
And as a savvy poster queried, Under what Colorado Revised Statute was seizure of your property and ticketing done?
Since the ticket hasnt been seen, and the OP has not given us details as written on the citation, I will join those calling "Bull Shit" until otherwise proven.

The Cherry Creek shooting range is under the jurisdiction of the Arapahoe County Sheriffs office. Denver PD would not have any authority in that area nor would they be able to ticket the op for the mags. If someone was down there claiming they were an officer then I would call the ACSO and let them know. Also no Denver water does not own Cherry Creeks water either. Besides who would want to drink that green soupy stuff anyways. Perhaps the op drank some of that water before going to range and suffered some hullcinations or ill effects?
can we please stop bashing the OP.
I would like to see more details on this, the ticket, or at least what he was ticketed for and hopefully the outcome if he decides to fight it.

Colorado Department of Parks and Recreation Rangers would typically be the first LE contact at Cherry Creek. After that it would be either ACSD or CSP. City and County of Denver has absolutely no jurisdiction over any Cherry Creek State Property.
Cherry Creek is actually owned by the Corps of Engineers and the State oversees it.
Denver Water has some interest in the waterways but none of the grounds.
I am dubious or the OP got rolled up and smoked by some clown who scammed him for his mags.
Or it is the weirdest thing I have ever heard of..

Pretty harsh everybody. If I was the OP I would tell you all to eat a bowl of dicks. Whether he was dupped or not is irrelevant. Instead of an assault why not try to be constructive? What reason would he have to lie? Maybe he was a victim of an eager beaver LOE who was outside his jurisdiction. I talked to him and he said that Denver PD has his mags and will be returning them after they find out whether they are illegal or not. Not sure what that means but maybe he didn't understand what happened either. Most of us do what armed officers tell us to.

If it was Denver PD that took his at Cherry Creek Family Shooting Center the OP and all of us that use that range have a serious concern. As I said in my prior post the ACSO has jurisdiction there , Denver has none. We are allowed to own 30 round mags in Arapahoe County. I shoot at this range several times a year. I have brought 75 round drums in for my Yugoslav m72 and nobody has barred an eye. My ARs and AKs have never entered the line with nothing less than a 30 round magazine. Something sounds corny with the story, and if Denver PD was enforcing their freaking stupid laws in Arapahoe County then the op needs to report them to the ACSO. I have been using that park for over 25,years and I have never seenDenver PD car thier, nor would I expect too. If some officer enforced a Denver county ordance in Arapahoe County he needs to be held accountable.

I usally don't rant on posts. What has me concerned about this one is that the poster stated he was confronted by a LEO from a jurisdiction with no authority in the Cherry Creek Park. I use that park and range and if someone is impersonating a LEO at this range and taking personal property from anyone there I have a big concern. Personally I respect law enforcement and i would be surprised that a police officer or agent from another jurisdiction would be there doing this in a sane manner. Out of decency the poster needs to follow-up with the Arapahoe Sheriff's office to make sure what happened was legit. I am not calling people names and i apologize for my comment that the poster may have drunk some Cherry Creek water before making the post, however if this story is true it is a safety concern for anybody that uses this park.

Same, one of the range officer picked up one of my spent casing and said no steel case ammo here anymore, but the next time i went with steel case ammo, no one said a thing. They sell casing for reloads, you can't reload a steel case, so I figure they didnt want to spend the time to use a magnet and pick out the steel from brass.
