CANTON, Ohio — An officer who was fired after being caught on camera making death threats and yelling and screaming at people he pulled over is eligible to get his job back.

Daniel Harless was relieved of his job earlier this year after multiple videos of his flaring temper went viral.

On Sunday, an arbitrator ruled that Harless is eligible to work at the department again if he gets medical clearance.

“Return to active service, if ever, is to be determined by competent medical authority,” wrote arbitrator Harry Graham.

“This is not a shocking ruling given all the things that were present for the arbitrator,” said Safety Director Thomas Ream, who fired Harless. “So we will abide by this ruling, and if officer Harless is able to get his medical clearance, we’ll let him back on the police department.”

Harless’ attorney stated his client is unlikely to return to his old job. He has applied for a disability retirement pension, according to Canton Rep.

In one incident, after quizzing passengers inside about their activities, Harless told one person, “If you scratch you balls wrong, I’m going to pull my gun and I am going to shoot you.”

I find it hard to believe that just because someone is eligible to be hired, that the police force will just let him back on the force. I'm eligible for that job, but I doubt they'd hire me.

You're not already a member of that particular police union. I'm guessing Canton's PD is heavily unionized, hence the intervention of an arbitrator. In a nonunion department, he'd be out on his ass for official misconduct.

Being Union makes much more sense. Pretty crappy when you can't just fire someone who does a bad job.

I would obviously like more details but I might be pulling my gun on anyone that tells me if I scratch my balls wrong they will shoot me. Fuck that guy and his threats. He needs that disability pension denied.

I dont think he could even handle being a greeter at Walmart. I would say give him his allowance just to keep him off the street.

The term is "lawsuit wearing a badge." I doubt any elected official would allow any PD to put him in contact with the public. If they have to pay him a settlement to avoid the million dollar lawsuit, it would be cost effective.

Winner! Canton PD is very unionized and that is the only reason he would be able to get his job back. I'm neither pro-union or anti-union but in this instance it is the only way the officer would have a chance to return to work.

Someone like that should not have the authority to arbitrarily pull over citizens and threaten them. If they hire him back, he should be given a clerk job or stuck in the motor pool where he'll have no contact with the general public while on duty.

Could someone explain why there are no criminal charges for behavior like this? Are officers granted immunity against things like this while on duty?
