View Full Version : Confusion on a Form 4 for Suppressor

First off, the suppressor is on a trust, not an individual.
I am mailing my paperwork today, and I was told by the dealer that the suppressor should be listed on the Schedule A when I mail in the paperwork. However, the ATF guy I talked to when I gave them a call, told me that it does not go on the Schedule A since the transfer has not been approved, which makes the most sense to me.
Has anyone here done a suppressor via trust, and if so, did you leave it on or off the Schedule A?

Yes, I've done several. I never put them on the schedule A until after the transfer is approved.

Same here, I've got several sets of paperwork in process right now and as of yet my schedule A is currently empty.

If the examiner is doing his job, your app will get kicked to problem status if your schedule A is truly empty. A trust is not a legally binding document until it is funded. True, you don't put any NFA items on a schedule A until they've been approved, but you have to initially fund the trust somehow to make it valid. Mine is funded by a $1 bill, serial number and all recorded on the schedule A and the bill locked up in my safe deposit box. A copy of the trust with my schedule A listing the $1 bill is what went to the ATF.

My Schedule A says "1. Any and all NFA (National Firearms Act) Title II regulated machine guns, short barreled rifles, short barreled shotguns, destructive devices, suppressors or silencers and other devices subject to NFA regulations with tax stamp rules."
That's all it says. It said that when I applied for my suppressor and it says that now, after I've had it here for months. I don't have the specific item listed.
When I bought my can I did not add the suppressor until my F4 was approved. But my trust was funded with 10.00 dollars making it valid like other have said above.
I have never ever sent them a schedule A (mainly because I utterly refuse to since it is none of their damn business what is in my trust) - and I have never had a problem w/ 4 different examiners.
Watch now all of mine will start getting kicked back.

Sorry you are correct, my schedule is funded with $10, so I mis spoke that it was entirely empty. I should have said it doesn't currently contain any NFA items.

The first Form 4 I ever did was sent back for correction because I didn't include a Schedule A. It was originally submitted in mid January, 2010.
What is really sad is that Form 4 came back approved on April 1, 2010. Approved in 10 weeks including the correction. I'm currently involved with a two Form 4 transfer situation. The first transfer just took 6 months including a correction.
The inconsistency of government regulators is one of the big frustrations now-a-days.
