I was denied benefits from a job I was working at for a year. I was let go because of many reasons but the final straw was a customer pissing off the owner by threatening to sue. And since I was working with the a manager and the customer I was the one fired. The customer got the killer deal on a product that the company got for free anyway and after it sat in a case for more than 2 months they managed to sell it for $200. All profit. The whole store was going under and no body was getting sales. We were tracked by sales no matter what they said and were pressured to upsale any computer sale with RAM, Anti-Virus and services.
That isn't a surprise and normal for most businesses. But after a year of service I know why they would write me up for sneezing, not making goal or anything they could. So if I was ever fired and filed for unemployment benefits they could show that everything has been papered to death and I could get screwed out of benefits.
I don't want them to be honest but after looking around for work for and running low on money I was doing everything I could to get somemore money including selling some of my prized property. They screw over the customer daily former employee's I don't know why I should be treated any differently. So here I am bitching hoping that I can prevent them from screwing over anyone else that might fall for their sales pitch.
Now I need to go to an appeals court and try to convince them that any writeups that were done in the last few days of work when they were making a hostile work environment hoping I would quit instead. Was just in case they had to fire me and pay unemployment. With the turnover that this company has I am not surprised that they know how to game the system and get their way.
I'm just in a hard spot and while I said I wouldn't do anything to screw them over in the future I was assuming that they would do the same. I should never assume.[Bang]
First thing what was the reason CO Unemployment denied you for? Second you can file a appeal but make sure you have all your ducks in a row and don't be afraid to tell them your side of the story even if it pisses off your former employer. When I did my appeal it was over the phone and the employer didn't even bother to call in so I won. Right now with the fiscal cliff BS all extended unemployment benefits will be cut off at the end of the year. Part of me says push Obama off the cliff but I really need my benefits so I can pay some bills and keep from going insane.

"YOU WERE DISCHARGED BECAUSE YOU DID NOT MEET THE ESTABLISHED JOB PERFORMANCE STANDARDS. YOU WERE MADE AWARE OF THE EMPLOYER'S EXPECTATIONS AND DID NOT COMPLY. IT IS DETERMINED THAT YOU ARE RESPONSIBLE FOR THE SEPARATION AND A DISQUALIFICATION IS BEING IMPOSED."
No emphasis added. They still write in all caps and no punctuation.

THE EMPLOYER PROVIDED COPIES OF SEVER (7) DIFFERENT COUNSELING FORMS THAT YOU WERE ISSUED DURING YOU TIME OF EMPLOYMENT WHICH WAS A LITTLE LESS THAT A YEAR. THE DEPUTY IS PERSUADED THAT YOU WERE GIVEN AMPLE OPPORTUNITY TO IMPROVE AND YET YOU FAILED TO COMPLY. THEREFORE THE DEPUTY FINDS THAT YOU ARE RESPONSIBLE FOR THE SEPARATION. "
Again all verbatim.
The whole store was failing to comply with expectations by which I think they meant sales goal. Only the manager that stole sales and made it a hostile working environment was the only person making goal. And while I disagree with several parts like working from Oct. 4, 2011 to Oct. 23. 2012 is more than a year. And I'm sure that 4 of those forms were written up and issued the days leading upto and the day of termination. I'm sure they didn't mention that to the deputy.
I always had to count my hours because they had a tendency to be missing days. I was always happy with the way they fixed the situation when brought to their attention. "Oh sorry let me fix that now."
There was a lot of BS that I was happy to put behind me. But they knew they fired me because one of the managers didn't like me and was trying to run me off. But when I didn't quit hoping things were get better they fired me for something that clearly was a setup. They had the nerve to fight the unemployment benefits in order to save a buck. This company has no honor.

IMO, I get the feeling you are not fully disclosing all the events that led to your termination. Having been on the managers side of the fence, you better have a good dispute in regards to the other 3 write ups that you make no mention of in your post. Sometimes, people just don't fit with companies and/or the job, and maybe this is one of those circumstances, and you are not giving enough information to determine otherwise.
BTW, if any product sits anywhere, for any length of time, it is not "all profit".

Sounds to me like you are not in a strong position. Colorado is not a "right-to-work" state, and I am glad of it. Go out and get a new job.
Sorry to hear you lost your job. I can't provide you with any answers to your current benefits situation but I am happy to tell you that despite what you hear on the news there are 1000's of jobs ready for the taking you just need to get out there and take one.

While this is true, most of them are either the $10/hr. menial labor jobs or the $75/hr. super technical jobs that require serious expertise - very little in between. If you can survive on $10 an hour, then great! Life is good and you have your pick of shitty jobs.
I was laid off and unemployed for 14 months. I submitted HUNDREDS of applications and resumes for jobs and had THREE yes "3" interviews in 14 months for what I would consider "comparable" jobs to what I had before. Most (like 99.9%) places didn't even respond when I applied, called, etc.
And I was not only applying for high dollar jobs. It got to the point where I was applying for just about anything. I finally resorted to taking a part time position with the piece of shit company that laid me off to begin with. I hate them, but I hate being unemployed more. In 4 years, enemployment will look even worse, so I'm just keeping my nose clean and making the best of it for now.
But this myth of thousands of great jobs being out there for the taking in bullshit. If you are willing to flip burgers or mop floors for $10 an hour and that can support you in your situation then you'll have no problem finding a J-O-B. If you are the breadwinner of a family and need a $30-$50K/year job to make ends meet...good luck bro.
I have been doing $10~ an hour jobs for years now. I have found that I can survive on less poverty level money. Or should I say I can't survive and live on a part time job paying that much. But I would take another one if I could avoid talking with UI and their BS. I have a steady supply of job feelers out now and I have yet to get an interview. It seems that if I can get that far I usually get offered a position. However, there hasn't been anything yet. I'm just trying to cover all my bases at the moment making sure I have done everything I can to get some money to survive on. I'm selling stuff I can live without. Filed for Unemployment Insurance (UI) and not spending money on anything but bills really. The UI was suppose to keep people from loosing everything when someone gets fired from job. Now just like everything in life I have to work hard to get what I want. Maybe it will help build character or something? Can't pay the bills with character though.
The statute that was quoted was 8-73-108 (5) (E) (XX)
I'm going to appeal just to figure out WTH they were talking about.
sorry to hear your troubles. I'm sure something will come up soon. Worst case scenario is apply for cabelas when they open up their hiring window!

Here's my take on it, There's a LOT of guys here that work in a variety of professions. Instead of trying to get advice on securing UI, post up your resume' and maybe someone here can point you to an open position. There's a lot of jobs out there that NEVER get published in job search websites/papers/etc because they only work on referrals. There's a lot of companies like mine that only advertise on their own websites for open positions. Post up your resume' and background and maybe someone here can point you in the right direction.
I can say this- if you don't mind shitty hours, shitty conditions, and can work your ass off, there are a lot of drilling operations that are hiring people who have no experience but the pay is great. If you can handle the conditions and all that it's good money and they're always looking for help. Good luck DOC!

Trust me, one of my very good friends is a roughneck, he's been on the rigs up north for about 3 years now and is moving up (IIRC he's a supervisor now). He bought a brand new Dodge Ram 2500 two years ago, no payments, cash, and asked the dealer to throw on a 3" lift and bigger tires... I almost wanted to sign up for that job!
I do like my Dodge Trucks. Diesel with a stick shift and seats 4. Hell yeah. But I need the job before I can dream about some nice toys.

Seriously though the oil and gas industry pays well. I went to North Dakota for a little while. Not as a roughneck, but as an electrician. The money being thrown around was ridiculious. Wish I could make that money again.
