With the usual caveat about believing anything in the newspaper, if the story is accurate this is the definition of a very bad shoot. Its tempting to say that a thief gets whatever happens, but I can't say I'll be upset if the thief wins a judgment against this clown.

According to a lawsuit filed in early October, Yi witnessed the theft on Oct. 25, 2010, and pursued Dewberry out of his store with a loaded .357 revolver, which fired as Dewberry was in the backseat of a getaway car.
Yep no longer a Threat.

The bullet hit Dewberry in the torso before it passed through his jaw and exited through a cheek, the lawsuit said.
The same projectile hit a 17-year-old passenger in the leg, Colorado Springs police said at the time.
Good Lord...how in the hell were these people sitting in the car? How do you get hit in the torso, have it come out your cheek and then hit some other dude in the leg?
OT though...bad, bad, bad. Can't shoot at someone running away. Chances are the punk will win the settlement and the store owner won't be able to keep his doors open.

Taking the article at face value, did the store owner overreact? Probably. But I have no sympathy for the thief. His bad life choices put him in a situation where he found the wrong end of the .357.

Yep. Not saying I would have shot him if it were my store, but if he gets shot while in commission of a crime lesson to take away is- don't be a criminal and your chances of getting shot drop substantially.

I'd say the thief gets nothing as his wound was received while committing a crime. Passenger similarly probably also shouldn't get anything as he more than likely was aware of the crime in progress. However, the store owner should probably be charged with reckless endangerment and unlawful discharge.

What I dont get is why this guy wasnt charged with attempted robbery and assault?
And apparently the shopowner had been wounded in a previous robbery, was assaulted in this one, and fleeing or not, likely was mad as hell and not in control.

Those would be appopriate as well depending on how the sheriff and DA see things. I'd be more inclined to go easier on him if he maintained a tight group but be worried about the public endangerment aspect if he was shooting wildly. Either way, both parties are at fault which is why I wouldn't give any monetary damages to the miscreants that started the whole thing but the store owner needs at least a misdemeanor charge for using his weapon when he was no longer in danger.

Dewberry probably saw the enraged store owner pointing the gun at him through the window, and was leaning/laying down against the passenger's leg/lap while trying to get away, or at least reacting to the impending shot. The bullet probably entered his torso at an upward angle, exited his torso up high, entered his jaw and then went out through his cheek, and into the leg of the passenger he was leaning/laying against.
Just my theory anyway. Bullets do wierd things.

Don't believe this shop owner will loose if the trial was held in Colorado Springs. The jury in criminal court refuseed to convict. Now if The civil trial is held in socialist Republic of Denver he may win big. Chances are both sides will settle before it gets that far. Lot of Frank Azars and Sals from breaking bad looking to earn a quick buck.
Should of went up his ars then out the jaw so he could taste the crap he was doing in his pants when the store owner came after him with a gun. Imo he's a threat until he is no longer around but it is what it is since he was fleeing it probably won't look to good for the store clerk.

He was a threat. Robber fled, owner perused, outside of shop then fired gun. Once the robber fled, he was no longer a threat. Force continuum stopped, so should the owner too. Then again courts have awarded beau coup bucks for hot coffee and nothing for cancer causing well water.

I agree, it's just messed up on how easy it can be to turn from a victim into the threat.
