I wonder if anyone from the Brady Bunch would like to comment on the fact that the case they're using as basis for this suit occurred in an area boasting some of the most stringent gun-control laws in the country. If gun-control works, how could anyone ever possibly be "gunned down" in Chicago? No comment? I didn't think so.

The suit was filed on behalf of Alex Vesely of Cook County, Ill. His sister, 36-year-old Jitka, was gunned down in the parking lot of a Chicago-area museum last year by a former boyfriend, Dmitry Smirnov of Canada, who shot her a dozen times then turned himself into police and later pleaded guilty.

More stupid shit. Armslist didn't sell the gun to the wacko. There will always be some dumbass or scumbag who will sell to someone they shouldn't.

More lawsuits to come.

Another step on the path...

standard procedure. sue everyone in sight. none of them will stick but all of them have to spend time and money on defense.

This will be thrown out almost immediately for more reasons than I can count. First and foremost is that they are publishers and not editors. Secondly buying firearms across state lines is perfectly legal - go to an FFL and do the transfer like the GCA (and armslist) tells us to do. They are just trying to burn armslist's cash down. Notice they didn't try this with gunbroker - and for good reason since gunbroker is flush with cash.

Why not turn the tables? How many BS law suits against those bastards would it take to keep them so busy in court they wouldnt have time to jerk other people around.

I am going to get crucified here, but I can see a potentially valid reason for the lawsuit. I have never used Armslist so I don't know exactly how it works but I am going to toss some what-ifs out there. If Armslist is making any monetary gains from the sale of firearms from the site or are in anyway operating as a broker for the deal then they are responsible for the legal underpinnings of the transactions.

Now if they are operating as nothing more than a forum to connect individuals and are not generating any revenue from the actual sale of the firearms, nor are they involved in the transfer of ownership then the lawsuit is silly.

I thought this is what they tried to do to the gun manufacturers years ago but it was unsuccessful if I recall.

armslist is a site for specialized classified ads. anyone can say anything on there. This is a blanket lawsuit with no merit.

And even if they were a broker/go-between why does that make them responsible in any way. If anything, the requirement that sales be done through a FFL with a background check (like gunbroker generally goes) would absolve them of any liability. Using the govt system to verify legal ownership is a strong defense. If you want to sue someone, sue the govt that runs the background search (never see them listed).

I have used Armslist, never paid them a cent. Much like our traders post here, pretty much anyone who agrees to terms can use it.

Has Craigslist ever been sued for the people who get mugged while trying to meet up with a seller? Or for the prostitution and drugs? Stolen cars?

Yes. Hundreds and thousands of times. None of them other go anywhere. They paid off the one chick (estate) that got killed when meeting up with the personals. But even then it was to make the problem go away it wasnt any admission of guilt.

There are so many inaccuracies in this story. Typical of the activist "journalism" so prevalent, nay, RAMPANT, in the major media outlets. For instance, "Federal law prohibits non-licensed dealers from selling guns to out-of-state buyers." Unless I'm reading it wront, this is patently false. I am not a licensed dealer, but I can sell a firearm to someone in another state provided I send the weapon to a legitimate FFL holder in that state to conduct the required transfer with the buyer.

Way to make the story fit your motives...

I think we need to sue the brady bunch for infringing on our right to bear arms and then have them classified as a hate group for civil rights violations.

What was the turning point for this country going absolutely batshit crazy? There used to be droves of upstanding individuals who took personal responsibility for their actions, worked hard for what they had and never felt entitled to anything.

We better be careful around here now though...the big bad Brady Bunch might get a hair up their ass and come after all private gun sales websites.

They think it's too cruel to hold certain individual responsible so they had to make sure the whole group of people direct or indirectly relate to certain individual are gold responsible.
Oh the political correctness.

Motion to dismiss for failure to state a claim... request award of attorney fees for frivolous/groundless/vexatious lawsuit, possibly intermixed with a counterclaim. I'd have fun with it.

No worries gentlemen, if this site gets sued it goes to me. And they really, really do not want to sue me [shithitsfan]
HAHAHA, unleash hell! I'm just wondering how much longer until the NRA finally goes after the Brady Bunch...

Never. Why would you go after your main revenue maker?
