President Barack Obama wants Biden to report back to him with policy proposals by the end of the month. Obama has vowed to move swiftly on the recommendations, a package expected to include both legislative proposals and executive action.

AND COSTLY, The court challenges will be stacked deep.
of course he wants to hear what EO he can make. Doesn't mean there are any. Someone gives you 2 choices, one of which requires dealing with an angry hostile mob, you are going to look hard at the second choice.
What can be done? well the days for your Saiga may be numbered, and semi 12Ga may go the AOW route. They rely on a sporting exemption now. Have to be careful here to not piss off the fudd birders though.
The man is not king/dictator, ther are limits to what he can actually do. I expect the limits to be pushed, but that's why there are 2 other branches of govt to slap him down.

just go along with it... it will be the law, you wouldn't want to risk anything.

Well I personally hope he oversteps his bounds, then many of the other "executive orders" and the whole of that side step to the checks and balances of the Constitution will come under scrutiny. As well the more extreme any order he issues the harder it will be to enforce, and the faster it will boil up to SCOTUS.
There is very little he can do that would be legal, but that doesn't mean boundaries won't be tested.
I lost faith in SCOTUS after their defining Obamacare as a Constitutional "tax".
We have Czars for all kinds of stuff that should be handled by Congress but is instead dictated by the Executive.
I don't count on my government to do anything right or just.

Considering it's 5-4 Conservative, that move still surprises me now, ugh. That tipping vote probably has a big Healthcare Lobby million-$$$ donation in his backpocket. Same with that "Corporate Personhood" BULLSHIT the SCOTUS voted for. What a shocking travesty. Oh wait, not shocking I guess.

You're talking about someone who is going to force you to PROVE he can't issue an EO and has a track record of going ahead and doing what he wants until he's forced to redirect. While we recognize he has limits, I don't think he does.

which goes right back to Jim's comment about it getting ugly and expensive in the courts.
As much as he wants to, he cannot issue an EO saying turn in your guns to the local eco-cycle.

Executive orders can not trump the Constitution, not that the shithead in office gives a damn about hte Constitution. [Bang]

Has a POTUS ever made an unconstitutional EO before? I don't understand how an EO is enforced. It's not law so how does that work?

... and therein lies the problem. I wouldn't be worried if he recognized limits to his power but he doesn't. Screaming "but I'm right and you're wrong" isn't going to do jack all if Obama decides he can write an EO to require extreme safety measures for ammo storage, slow down and throttle NICS background checks, tighten interstate transfers, etc. Sure, we'll be fighting it in court but that will all take years before getting a decision and they will try to implement and institutionalize the restrictions while the fight is going on.

EOs are enforced through the powers of the Executive branch. That can be in how they process paperwork, administer taxes and fees and use federal law enforcement powers. He doesn't even have to prosecute anyone -- just having EPA or OSHA issue regulations regarding ammunition storage would have a major disruptive effect.

So there's no reason he couldn't issue an EO that says all semi auto now fall under FA NFA rules.

Oh, there'd be a legal challenge but in the meantime, BATFE would be processing according to the new EO unless/until someone convinces a federal court to intervene. I'm more worried about more subtle EOs that people will think is harmless because they're uninformed or don't think the problem all the way through. He's a lawyer -- expect him to be devious.

that EO would contradict existing law from the Legislative branch so he could not issue it (and expect it to be enforced)
