View Full Version : High powered armory in Youngstown Ohio: Gunbroker question about a shady seller need help.
I would just like to know what rights you have as a buyer if the seller does not cooperate? Like if I won a auction that the seller stated he has plenty of the item in stock but will not ship it out, and wants to give back the money instead. This has been about a month ago and this guy is threatening to leave me bad feedback just because I told him if I did not receive my item I was going to reflect my experience with my feedback. I had a hard time getting payment info and even harder time getting a response out of this guy. I believe he is trying to price gouge me or does not have the item he stated he had. I have also looked into his feedback and am not the only person that is having this issue. Thanks for your help.

I would get my money back as quickly as possible and then worry about feedback. If he doesn't have the item you won't have a lot of luck pressuring him. Why do you think he is trying to gouge you? Did he ask for more money?

Just get your money back and call it a day. I have walked away from a lot of deals when people start jerking you around. Person keeps moving the date and time around for the transaction, they don't respond to emails, or phone calls. Save the headaches for something more important.

Did he ask for more money? That is just what it seems like to me as it feels like he is trying to wait me out. I have already had this problem with another guy on there and it is getting old. From what I have read on his feedback even if I get a full refund he will take just as long to send that out. I just want to know if I can file fraud against this guy? I told him I was going to do this first thing on Monday if I did not receive a shipping number of some kind and he basically told me I should be careful with the term fraud as I might not get my money or the item. He even stated that I can only use that when an item has been paid for but not received, which is exactly what is going on.
Sounds to me like he agreed to sell you Y for $X, then the market went nuts and now he could sell Y to anybody else for $XXX. So, he wants out of the deal with you so he can triple his money (or more) with some other schlub. Get your refund and be the schlub that got away.
Oh, once you have your refund, smoke his ass with bad feedback.

depending on the money spent, feedback him anyways, and contact gunbroker. If he isn't delivering the goods in a timely fashion and making veiled threats about you not getting either and you have proof, he can blow you. Just run him through the system and let him deal with the fallout of being a douche.
Was it something that would have been effected by the O'nonsense? just curios as to what you're missing out on.

Contact GB. Seller is obligated to provide the item. However- no none can force him to do anything. The worst you can do is leave poor feedback. He prob doesn't care about that. You might be able to get his account suspended. That might sting the seller a mite.

Screw him, keep your money and move on. You need someone to screen any & all deals you do on line. Or stop buying shit on line. ABC always buy Colorado.
PS: Have you contacted GB yet?

Gunbroker has a fraud link on the side that I wouldn't be afraid to use. Especially if he has your money and hasn't shipped your item. If he is holding your check or something to clear his bank, then it's understood that it might take some time to ship, but if you sent him a money order or used paypal, then he needs to get that item in the mail or give you his money back. Gunbroker doesn't take kindly to people that don't abide by their rules.

What was the payment? Was it a US Postal money order? I'm pretty sure there are rules surrounding its usage (which is why most people ask for it specifically, not a generic 'bank money order').

PS: Have you contacted GB yet?I tried the resolve with seller but cannot file fraud until monday which will officially be 30 days. But from what I understand and maybe I am reading it wrong if I file a fraud claim I lose 100.00 bucks. Is there some other way of contacting GB?
Under the GunBroker.com Buyer's Protection Program buyers of items purchased through GunBroker.com are covered for amounts up to $500 with a $100 deductible against fraud. For example, if the winning bid price is $500, you are eligible to receive $400 in the unlikely event of fraud. Every GunBroker.com buyer is automatically covered at no charge under the terms of this program. The coverage is effective for any item listed on or after September 15, 2001. While fraud is virtually non-existent at GunBroker.com, our Buyer's Protection Program gives you as the bidder the peace of mind to bid and buy with confidence. Our Buyer's Protection covers two specific forms of fraud:
You pay for an item and never receive it, or
The item you receive is materially different that its description, such as winning a stainless steel pistol and receiving a blued one instead.
To be eligible for Buyer's Protection coverage you must be the winning bidder of an item as defined by our User Agreement. 'Side Deals' in which you were not the winning bidder, items bought or sold through the 'Want Ads', and any other transaction in which you were not the winning bidder of an auction here are not eligible for Buyer's Protection. Damage sustained in shipment is not covered by the Buyer's Protection; it is the seller's responsibility to insure the item against damage in shipping.
If you are having a problem with a seller and believe that you have been defrauded, please do the following:
Try to contact the seller directly via email, telephone, or snail mail. Many problems are either misunderstandings or difficulty in communications. You can use Resolving Problems with the Seller located in For Buyers to request the seller's contact information and call or email him.
We strongly recommend that buyers and sellers work together in an attempt to resolve their dispute.
Review the Fraud claim process to understand the claim process and to determine if the item is eligible for Buyer's Protection.
If you have been unable to work the matter out with the seller and 30 days have passed since the ending date of the auction, you can file a Fraud report. To allow the seller sufficient time for communication between yourself and the seller you must wait a minimum of 30 days from the date the auction ends to file the Fraud report. The Fraud report must be filed within 60 days of the end of the auction; claims made after 60 days will be denied by the insurance company.

So you are the one that had the winning bid on the 3 used PMags that had the punisher decals on them......[LOL]
I asked for my money back and this guy told me it will take just as long to return my money. He said he will not give me a refund until my ticket comes up, which he cannot give me a estimated time. There has got to be something I can do any advice on just getting my money back would be great. Thanks

be prepared to fightWhat do you mean by fight? And I want to put a complaint in with GB but do not want to lose 100.00 or am I wrong on this? I do plan on leaving him very detailed horrible feedback once I receive my money. With a USPS money order can't i just go to the post office and file fraud against him this way? Thanks for your help.

I'd file a complaint against him with the bbb. Sounds like he has an established business and that hurts more than a bad gunbroker review. Of course after you get your money back.
Might speed him up if you tell him you're thinking about going to the bbb.
Just an idea.

Get your money back, Contact GB, Blast him on the feedback. Send all correspondence between the two of you to GB. So they can see he's being a douche! Then let everyone here know who he is, so we do not deal with him!![2cents]

If I remember correctly, I put in a "fraud" complaint against a seller a number of years ago. GB immediately suspended his account until the situation was resolved. Seller didn't like that very much and immed took care of me.

Really I meant, as in to present a case against him to GB or a small claims court if it comes to that
have all of your ducks in a row, receipts, correspondence, proof of ill-dealings.

I had a similar situation on Auction Arms (or whatever they call it now).
Without going into boring detail, I had to threaten to call the postal police (paid by money order) and make a report to the local police where he did business. I was always polite (well mostly polite) as I figured I'd be sending the email trail to the police or Auction Arms.
The good news is I got my money back. The bad news is the seller reported me as a non-paying bidder and I was kicked off Auction Arms. He left me scathing feedback. I sent Auction Arms our email trail and was reinstated, and left nasty feedback on that fellow as well, but he is a big seller there and Auction Arms has no intention of doing anything to him.
The problem with these sites (which I have used often), is that they depend on the sellers for their income; buyers are expendable, especially with the current state of the gun market.
For what it is worth, I've never had anything but positive experiences on Gunbroker.
Good luck

What's his username on GB? I can't find him when I search different terms. I'd just be curious to find him on there.
Oh, from what I've read elsewhere, filing a fraud claim with the Postal Service is an exercise in turd polishing. They're not exactly the most efficient or caring, ya know? Very low give- a-shit factor.

I can only laugh when I read these threads. 99.9% of the time it is a competitor and the. 1 percent is an attempt to Rally a group of people with false statements and try and bash a company. Our company has never kept anyones money if we didnt have it money was refunded immediately. Our BBB record is flawless and our facebook following receives 22,000 visits a week. If there is a claim we took your money put it out on the forum i will be glad to post your tracking or a copy of the refund check. The bottom line is any claims of keeping customers money is a flat out lie and can prove it as soon as you provide an order number. Our just continue to provide consumers with lies. We will be waiting for this info so we can provise an IMMEDIATE response

So what is the truth High Powered Armory? Not a very businesslike response from a potential customers point of view. Calling our members liars, doesn't inspire confidence in me as a consumer. Oh and is "Yoingstown" purposely spelled that way?

The truth is we have never ripped a customer off ever. Our company is far to large for that. We are separated into two divisions our Retail manufacturing company LE/Military sales and NFA and Our wholesale divisions. We filled over 18,000 flawless orders over the last 3 months and what a customer was offered the item for was what they paid we would never asked someone to pay more. Our only reason in later sales of a price increase was due to the price increase of parts which affected us all. But to say we took someones money is a flat out lie I am not calling a forum member a liar I am saying if anyone said we kept their money they are misleading others. If we ran out of stock on an item we immediately refunded money we don't back order we only sell what is in stock. We have received the top seller award for amazon sales for firearms parts this is a world ranking. we have been voted number 1# in Ohio and PA from numerous consumer reports for sales and prices. We have been one of the only distributors that has not asked there customers to pay more. While others raised there prices to over 2000 dollars on ARs we still offered ours at a pre panic price. 24,850 people have viewed our page this week alone please point out one negative comment left. As you can see from this forum and others the first thing when someone says they had any sort of issue is blast them with negative feedback. Why was the auction not posted nor details about the transaction. I will be more then happy to address them when we are provided with details.

Your absolutely right we have earned our reputation of being one of the most sought after names in the business. I personally take the time to address each and ever situation. I would think the next step would be forum members to ask the buyer for details so he can be compensated if in fact compensation is due. I'm not here to fight with members just here to sort this out and correct any potential oversight if indeed there is one. Is this not what a reputable business does?

Hurley this is exactly how a situation should be handled with a logical question. We only signed on to address this claim and help this customer out. Our internet legal team stumbled upon this and directed us to the link. Our goal here is to pin point the transaction and any sort of issue there may have been. We have found that our biggest issues have been with non customers not sure why we address all complaints and our main goal is to get to the bottom of it. We didn't ask for the panic and we sure did not ask for the attitude of the panic buyer. When the price of ammo was increased from our distributors we completely pulled it from the shelf. When we get 5.56 cases of 1000 they are on our floor for 389.00 when others are 800.00. It is extremely disappointing when people with no dog in the fight have no intention of assisting a fellow forum member they want to start a witch hunt.
