A federal appeals court panel unanimously agreed that President Obama violated the Constitution last year by appointing three members to the National Labor Relations Board (http://articles.washingtonpost.com/2012-01-13/politics/35439661_1_recess-appointments-intrasession-recess-justice-department) while the Senate was not technically in recess, circumventing Senate Republicans who had held up his picks for months.
The D.C. circuit court’s ruling could also raise questions about Obama’s recess appointment of Richard Cordray (http://www.washingtonpost.com/politics/richard-cordray/gIQAT5kfKP_topic.html) to lead the Consumer Financial Protection Bureau, which is being challenged in a separate case.
If the ruling stands, it would invalidate all the decisions made by the NLRB since the appointees joined the board.

Personally, I think if a politician tries to circumvent checks & balances by premeditated and deliberate sneakery, such as conducting official business when Congress is empty or adding a few lines of completely unrelated text in the small print of a 100+ page Bill, they should at the very least face ethics charges and a review board.

I agree 100%. Deliberate attempts to circumvent the Constitution should lead to impeachment and criminal trial.
Something will miraculously sprout up and draw attention from it and it will fade away......

What are you talking about? Its already happening with the pending AWB and other gun bills, not to mention the fiscal cliff that seems to have been forgotten by the vast majority of people because guns are scary and should not be in the hands of law abiding citizens... [facepalm] (I feel like this is the only smiley i've used for the past few weeks... )

When I was a kid, I learned that if I misbehaved a little, out in the open, it distracts the responsbile people from the real mischeif...but I was just being a boy, not ruining a country.

even if something does pop up to distract the news it wont distract the courts. So long as someone is paying enough attention to invoke the courts it does appear they are doing thier job.

Haha, I just googled it and then hotlinked the sarcasm smiley. I swear we do need a sarcasm smiley on this site, especially with all of the noobs joining up and not understanding our humor.
