These proceedings will be interesting, as their fight may very well become one we have to deal with.

Good for them. I had zero doubt this would be challenged quickly and I have little doubt their stupid law will survive the challenge.

However, this will make it to SCOTUS no matter what because we're in the right and will probably win on every level, and they think they're right and will challenge on every level. They should actually go for ALL magazine bans, including the old 10 round one (I didn't read the suit, maybe they are doing that). They should go for the whold Sullivan Law too because that's a big infringement.

This is a violation of the Fifth Amendment, not the Fourteenth. They had probably better get their shit together before they go to court.

I just hope it can set a precedence.... especially if Prima is right and it goes all the way up to the SCOTUS, then it will effectively set the bar and state that any magazine capacity ban is a violation of constitutional rights.

Heller v Dc addressed some of this.

Yes, a big win for our rights, but we need something setting judicial precedence on magazine capacity... I'd prefer if Miller had been more robust in the ruling.

Boy, that video is f'ing great! I was cheering and clapping, and no one else even in the room with me.

I hear from one of the Oath Keepers in New York that this scene has been repeated at every Town Hall the city has conducted. New Yorkers are not taking this lying down.

No they are not. Some douche bad gun grabbing liberal admin feels empowered by an election. Guess again. There's a reason 2.7 million BG checks (not gun sales) were done in Dec. One thing to remember, the urban Emotional Voters out number the Sensible THINKING Voters, in NY and else where . In CO, VA, NY, ILL etc. You do see a wide spectrum of Gun owners in that audience. Once again the talk about an AWB has produced a ground swell like no other time in History. lets not waste it.

I think the best shot this case has is claim II D. Takings law is fairly well-establishe (http://en.wikipedia.org/wiki/Regulatory_taking)d. The biggest obstacle will be e translation of real-property precedent to personal property. But that's not a huge leap.

The lyrics of the background song in the video of western New Yorkers raging at cops at a town hall outreach - the Rolling Stone's "Gimme Shelter" - are chilling given the context/volatility of the gun control issue and the nation's worsening political and social estrangement.

Ooh, a storm is threat'ning
My very life today
If I don't get some shelter
Oh yeah, I'm gonna fade away

War, children, it's just a shot away
It's just a shot away
War, children, it's just a shot away
It's just a shot away

Ooh, see the fire is sweepin'
Our very street today
Burns like a red coal carpet
Mad bull lost its way

War, children, it's just a shot away
It's just a shot away
War, children, it's just a shot away
It's just a shot away

Rape, murder!
It's just a shot away
It's just a shot away
