If I put my 649 S&W in my back pocket, and the butt sticks out an inch or so. Am I illeagly. Concealed but, The butt. Open carry because you can see it. I sounds like it could be a gray area. Any thoughts?????[Dunno]

I would say don't risk it, and put it in your front pocket. Besides, isn't it extremely uncomfortable to sit on a revolver?

From a pure legal standpoint, i would think you would be safest just playing by open carry rules. Meaning, i wouldn't walk around Denver with it visible. They may say you are opening carrying and charge you as such. I don't know of any case that has tested that, are you willing to be the first? If you had a permit to conceal, and you were open carrying (or it were visible) i would say as long as you were doing it legally you would be fine.

My advice would be, conceal the firearm, or open carry it.

If you don't have a permit, Open carry in a holster is my advice. The whole Denver thing is another story anybody wish to film me walking down Lodo with my surbu so we can illiminate this myth that you can't open carry in denver once and for all????

There is no law in CO that says you must conceal it so if you have a permit you can basically carry it however you wish.

I have a nice Sony HD camcorder that doesn't get nearly as much use as it could, i'll film you. We can go down to LoDo on a baseball game night, and walk back and forth past the officers until you either get arrested, or they just ignore it. I'm assuming since there are statutes for open carry within Denver, it isn't a myth. But i would be happy to film the arrest and subsequently post it on youtube :D

I know Thornton and i believe Aurora (could be Arvada) both have some kind of law regarding open carry. I know when you go into a park in Thornton, it is clearly posted you may not carry a firearm. It doesn't specify concealed or otherwise, i'm just assuming it means open carry.

Let me take you to law school 101 pick a date. :D

I am not talking parks if they are posted it is a no go (open carry) I am talking downtown denver open carry. Lodo 16th street hell I don't care pick a date and a place.

Your problem is you "assume" and we all know what that means.

The surbu will get the most attention for the best effect so pick a date and bring your cam corder.

If I am arrested I will share the massive law suite with you. ;)

Has anyone tested this law in court yet to your knowledge? I've always just assumed open carry in no go in Denver because that's what everyone has told me. Would certainly be interesting though.

Hmm .. Denver's Home Rule status has been reaffirmed too many times. Any one have a link to firearm regulations for the Peoples Republic of Denver? I would suggest those be reviewed prior to attempting to contest Denver County and City's home rule BS regs.

Or at least wait until Heller V DC has a ruling.

I have a ccw, and perfer it in my back pocket. So if the butt is sticking out, I'm I breaking any law??? [NoEvil] I have carried for years this way with no problem. Once a lady told me, "You have a gun in your back pocket". I said, "Yes I do, and if a robbery were to take place, who do you want next to you, Me or the president of handgun control". [ROFL1] I read that somewhere. She laughed, and said "You got a point".

I have carried for years this way with no problem.

Why you asking us then? Seems you have a handle on it better than any of us. If you've done it for years without incident, i would say keep on going. I don't think that's a very good method of carry. If you're gonna open carry you should have some kind of retention. In your scenario, not only do you have no retention, it's visible from behind, and you have no way to protect it if someone else grabbed for it. It's your choice, so meh.

You have a permit, open carry is legal in CO, you're g2g either way.

[Dunno]I guess I'm still confused. I know it's a gray area but I think I'm legal.

Well here is how I see it .. if you are carrying concealed.. conceal the weapon. Additionally, if I saw you carrying just in your back pocket and not in a holster, I'd say something to you.. e.g. .. dude your gun's showing and put that thing away or in a holster. But that's me and I'm a tad crass some times.

If you want to test the open carry laws.. please have fun, I'll support you as long as you are smart about what you do to test them and are also smart enough to take a copy of both the state and local regs with you.

Why do you prefer to carry that way?

OK, Today I went and bought a Mike's soft hostler. [Tooth] Tried it out all day and kinda like it. For me, I like the easyness of putting it in my back pocket. Never do I go anywhere with out my wheel gun. I have tried leather and never like it, but this soft hostler fits inside my pants very snug and comfortable. Thanks for making me realize this so I don't plan on going too [Jail].

I guess I missed if you had a CCW or not. If you have NOT, and you get caught any where with your shirt or coat (what ever) covering your piece you, "go to jail". You can hide it in your car or under your coat all day long as long as you are in your car. As soon as you step out of your car it better not be hidden.
My 2 cents

Liberal do-gooders happened. You know the drill....First, only criminals own/carry firearms. Secondly, only a dispicable criminal would conceal a firearm, so we have to license (translated: tax) you to make sure you only have good intentions.
