Time to strike back. To hell with crossing our fingers that they might see the light after 12 hours of testimony.

I stated last night that I am willing to do a lot of the legwork to set up the recall committee, etc. I have an extremely open schedule.

I'm currently reading up on the state rules but if anyone has experience please contact me.

Major notes:

60 days to gather enough signatures, 25% of the votes they received in the election.
Must be a registered committee once it receives or spends $5,000

state link (http://www.sos.state.co.us/pubs/elections/CampaignFinance/committee/recall.html)

I don't know if all the signatures need to be from their district. I'd imagine if not, it would be easy to get the signatures by distributing petitions to gun shops throughout the state, reaching out to Magpul, etc.

Of note:
Q8. What do we have to report?

A8. For contributions of $20 or more, the name and address of the contributor must be reported.

For contributions of $100 or more, the contributor’s name, address, employer and occupation must be reported.

At this point, I'm not even sure what the money would be for. I might be thinking small scale though. Maybe if we were running commercials, etc it would cost more.

FAQs for recall committees (http://www.sos.state.co.us/pubs/elections/CampaignFinance/FAQ/recallCommittees.html)

My thought is Rhonda Fields needs to be the primary. Any others? All others? I'll make 10+ committees if I have to.

Best post I've seen thank you for the information. This will be on standby when and if my legislators deny my and everyone else in my districts rights.

I was reading a little about this process last night; it looks like you found more than I did. [Alrigh]

As I understand it, the number of signatures needed for the petition in order to start the recall is 25% of the people who voted in the last election, for that particular office. I would be surprised if it were allowed to be voters outside that particular district, but that doesn't mean it isn't true.

There were two successful recalls last year in Colorado; perhaps we could reach out to the folks who participated in those committees for guidance. I'd also be willing to bet we could get assistance from a couple of the Republican Reps on the House Judiciary Committee.

Thanks for taking the initiative to start organizing this process. I am in to help and participate in whatever way I can.

I would focus on legislators who don't vote their districts. For instance; Senator Nicholson from my district who represents West Jefferson and Gilpin Counties. Target all the rural Democrats.

Fields, although dumb as a box of rocks, is in a Democrat stronghold so it is a waste of time to go after her.

Ronin13: you have the same dumbass senator that i have (and one of the most left wing members of the legislature). I am willing to put work into getting here dumb ass out of there.

Yep... If nothing else we should be riding ourselves but I fear the Obamaton robots have invaded Evergreen and Morrison... so it could be a battle.

She won her seat in 2010 by around 500 votes (I can't remember the exact number) The redistricting map made it worse, but she is so far left that she can be attacked. if nothing else, it would be good to recall her every year just to piss her off and make her work.

I like the idea of filing a recall petition against every one of these people who are representing only their party or themselves instead of the people, whether there is a chance they will be recalled or not. However, if an official survives a recall election (keeps his/her seat), a new petition for recall cannot be filed against that person for the duration of that term.

In the case of Jeanne Nicholson, she has an election in 2014. Recall her in 2013, make her campaign in 2014, and recall her again in 2015.

Districts I am in are well represented, so no recall needed here, but I'm game to help out where I can if you guys decide to target a district or two.

Fundraising would come in for the actual recall election, funds for the petition should be very minor (maybe pay for someones gas or lunch, maybe some printing costs...).

Below, I put five Senators that will be vulnerable to gun legislation votes....put a lot of heat on them especially if you are in their district. If they don't listen, recall them.

This was a republican district and should be targeted (you guys up north contact him a lot)

It won't be possible to recall them all and if spread too thin we won't be able to recall any. Just like with vampires, go for the leader (chop off the head, whatever) and the rest will get the message. Go for that John whatever guy, do it loud and public and even if it's not sucessful, getting close will send a message. You don't hear much from that moron Walker in Wisconsin since he almost got ousted.

I'm all for writing everybody, and for informing them you'll have a personal and financial stake in defeating them next election if they don't vote pro-2A. But I thinkthe threat of a recall is probably going to be unlikely to persuade - it's long odds, and they know it. Otherwise, they would have listened to the majority of opposition that voiced itself in the committee hearings.

As somebody who has actually showed up at the hearings this week, you need to take a clue. The Republicans are all on the side of the angels on this. They've ALL voted against these bills. NONE of them have sponsored the legislation. You need to direct your fire at the democrats that aren't in Boulder and Denver. A recall isn't a threat, you won't get enough signatures. What will get their attention is that you aren't sitting out the next election, that you're going to give money, walk doors and make calls AGAINST THEM.

We'd have 60 days to get the signatures and submit them. I think there's also a 6 month from the election deadline, so that puts us at about April for filing new ones. If we try to do the one and see how it's going, then go after any others.

I'm running a similar thread on Arf and someone was nice enough to post election results, including voter totals. The Fields election only had 20,000 voters, so we'd need 5,000 signatures to trigger a recall. Unfortunately, it was almost a 75-25% win for Fields.

I'm putting together a list of questions I plan to approach the Secretary of States office with, but if anyone has any questions or input, please share.

I've noted that even if we get the recall, it doesn't guarantee they won't get reelected, so start thinking of possible candidates to run against these people.

It was stated yesterday- Fields fears no threat of recall- her district is very democratic, and getting her ousted would be extremely difficult, if not impossible... Sad but true.

Fields won by a huge margin in 2012: 73.3% of the vote. 22,362 people voted in that election, which means we would need 5,591 signatures on the petition to recall her, and she has a strong D voter base that may just re-elect her.

We would need 9,658 signatures to recall Kagan, but he just barely won (50.8%) in 2012. Seems like an uphill battle, but not impossible.

If a petition with the required signatures is filed, the incumbent has 5 days to simply resign before having to go through the election process again. I say file them one at a time, starting with the easiest to recall, maybe Kagan, and go down the list. Some of them may just throw in the towel.

This is just the House, not the Senate. I emailed them earlier this morning. I focused on how if they are true to their word and they find it worth it if they can save just ONE life... they won't vote for these measures because they put thousands if not millions of lives in danger. These are dangerous measures that have the potential to cost lives because of them. If they want to save even just ONE life, they will vote NO against these measures.

The first few responses I have received:

I will be supporting your 2nd Amendment rights and working hard to oppose any legislation that violates your liberties and rights.

Thank you for your email. I will be voting no on these gun control measures, that attack the second amendment instead of addressing the few people who miss use firearms.

Thank you for contacting me about gun issues. We are considering various options and I appreciate your input. Best of luck with your education.
McCann's would be a "screw you" to me since I mentioned having to give a lot of thought of where I went to law school if I were not allowed to carry on campus.

I'll vote "No" on any/all gun control legislation.
The Second Amendment exists to protect us from tyranny and I will not compromise on that issue.

If you'd like to learn about my efforts to defend the Second Amendment rights of law-abiding citizens, then please take time to read this recent article:

http://thecoloradoobserver.com/2013/01/gun-rights-backers-rally-at-state-capitol/

You might also enjoy listening to the speech that I offered during the "Guns Across America" rally that was held at the Colorado Capitol on January 19, 2013:

Chris Holbert At Gun Appreciation Day 1/19/2013, Denver CO (http://www.youtube.com/watch?v=F0qYp9BNqpc)

There was no doubt in my mind that Chris was on our side! We need more like him!

I assure you that I too respect the Constitutional right to bear arms.
Moreover, data indicate that gun-control legislation does not prevent
tragic shootings.

I fully expected a great deal of pressure from those who want control
over all facets of our lives. Despite many Coloradans' testimony
opposing the gun-control bills, the House committees to which they
were assigned passed them. Perhaps the vote of the full House
membership will be more responsive to Coloradans' views.

Thank you for your message and for your defense of our treasured
Constitution. I encourage you to continue sharing your thoughts and
concerns with me.

Representative Everett is endorsed by RMGO (Rocky Mountain Gun Owners) PAC and is committed to protecting our Second Amendment Rights. I have attached two press articles quoting Representative Everett and referencing his sponsorship of 'Make My Day Better Bill.'Please stay tuned as legislation is introduced, debated and voted.
I encourage you to reach out to additional Representatives to stress your views.
There will be hearings for the public to provide input and we encourage you to participate. Watch for hearing updates on the leg.state.co.us website. I am also attaching the RMGO PAC website which will enable you to track state legislation as it relates to our Second Amendment Rights.

I called the SoS and got directed to a .pdf on the rules. Lawyer speak (http://www.sos.state.co.us/pubs/elections/LawsRules/files/Title1Final.pdf) Article 12 is the one regarding recalls. Starts on page 299.

I don't speak legalese, but from what I've read;

The person(s) starting the petition must be registered to vote in the officials district.
Anyone who signs must be registered to vote in the officials district.
The 25% rule we've already covered.
It appears we'd have to WAIT 6 months after the election to file.
File a 200 word or less petition to the SoS for approval explain why the official should be recalled. Once approved, it would be the petition that people would read and then have a signature page attached.

IF the official being recalled re-wins the office, any money they put into being reelected is repaid to them by the state treasury Section 1-12-120 So the idea that this will cost them money could backfire.

This was my first reading of it, but it appears that we will need people in the districts to do this. I'm not sure if there needs to be an official rep or committee as long as the $5000 limit isn't reached.

The Senate elections are staggered. Some of the Senators that were elected in 2010 are fair game now. They have four year terms.

Feilds won because Obama was on the ticket, if subject to a recall I do not think she will have the support she had them. Given almost any viable option, she would likely lose.

Morse and Fields would be the prime targets, because they are the instigators. Morse's position is not very solid and he won by the skin of his teeth.

Regardless, just getting the issue of a recall HEARD should be enough, because there is a serious risk these folks will lose, especially if they have to actually talk on points other than " I oppose Romney, I stand with the President etc etc".

If word of a recall effort hits the media it might get some legs. If anyone has media contacts I'd advise to use them to make sure the media knows this is happening. Hopefully they will start asking questions of our elected officials and make them sweat a bit.

It's so easy to tell which one of our Representatives are the good guys by their email replies. The bad guys don't give a [pileoshit]what we think.

for example:

Good guy

Thank you for your email and your concern for the Second Amendment.

As a member of the House Committee on Education, I've already voted
"No" on one of the bills. The slate of bills is now scheduled to be
heard on the House floor on Friday, February 15 beginning at 9:00 a.m.
I will vote "No" on all so-called "gun control" legislation.

The Second Amendment exists as our defense against tyranny. I will not
negotiate with your Rights under the Constitution, which means that I
will not compromise on the Second Amendment.

Please, if you are able, come to the Colorado Capitol Friday morning.
Sit in the House gallery and hear for yourself what supporters of such
misguided legislation have to say.

If you have Comcast cable service in the Denver area, then you can
also watch us on channel 165. You can also watch or listen to
proceedings on the House Chambers online at:

http://www.leg.state.co.us/clics/clics2013A/cslFrontPages.nsf/Audio?OpenPage

It is an honor and privilege to serve in the Colorado House of Representatives.

Respectfully yours,

- Chris

Cherylin Peniston's reply was basically "I support closing the private gun sales loophole and I haven't made up my mind about anything else." Or words to that effect.

Westminster peeps need to lean on her. Although her district is mostly (all?) Adams County, so it may be a safe Dem seat anyway.

Or not. In 1994 everybody thought Dan Rostenkowski (D-IL, inside the city of Chicago itself) was safe as well and we managed to throw him out of office.

Anyway, if this bullshit comes to a vote and Peniston votes for either 1224 or 1229, I've got the maximum legal donation ($200?) for anybody who runs against her. Ditto my state senator, Steadman.

+1 getting help from those who have already gone through the process would be priceless. Who were they? If it was a republican group I'm sure they'd help.

Just stated that I wanted to avoid pitfalls of inexperience, etc. Haven't heard back. At this point I plan on being at the capital for the vote tomorrow. Parking was hell Tuesday.

Nicholson sent me a form letter, she's obviously unable to listen to reason so I sent this to try and inspire a little fear that her job is at stake:

Senator Nicholson,
In light of your response- albeit a form letter- you have proven yourself incapable of actually listening to the mass amount of people in this state, including industry leading, Colorado based company Magpul Industries, regarding this proposed legislation. I am left with little option but to recommend your name be added to a list of other Colorado representatives in a request for recall that a large firearms community I belong to has been setting up. You clearly have no interest in respecting our rights to own and possess arms as outlined by the second amendment to the US Constitution as well as outlined in the Colorado Constitution.

Guns = Power
In the wrong hands, great tragedies are committed.

Political Office = Power
In the wrong hands, great tragedies are committed.

Great tragedies, like a wrong-minded person, attacking our rights to life, liberty and the pursuit of happiness. When a person decides to willfully attack us, we have the choice to fight back or give up and accept our role as a victim. Both perpetrators of these heinous acts are committing them with full knowledge of the consequences and results of their actions. The shooter in a school theater, mall or church knows full well the act they are committing is unlawful, yet they don't care about the public's opinion of them or their act. The politician that sponsors or votes for an unconstitutional bill is also aware of the lawful violation they are committing, but they do care about public opinion.

Some politicians believe that it is their right to enact laws that are meant to protect the people from themselves. These politicians feel it is their right. However, it is merely a privilege, granted by the people, to serve the will of the people. What is a right, is the inalienable one granted to us by the 2nd Amendment of the Constitution of the United States of America.

A politician will use all of the tricks of the political trade to ensure they acquire and retain power. District manipulation, disguised bribery, backroom deals and worst of all, removing the means from the people to react to tyrannical authority over the people. When the will of the people is no longer respected, the entrenched politician needs only to fear the people's means to forcibly remove them.

Colorado has suffered some horrific tragedies in our recent history. None have been as tragic as the rogue politicians in office today, that have endangered the citizens of Colorado, with their well meaning legislation. They are using their people-granted power to infringe upon our right to defend ourselves and those we protect. They are also ensuring that as they continue down the path of stripping away our liberties, that we will eventually be powerless to stop them.

Please join me, and the thousands of others in Colorado that are outraged by these recent abuses of power and recall the rogue politicians in office today. We may still have our guns today, but unless we vote, we will lose more than just our right to bear arms.

I've provided all the info I can find. I never heard back from the Colorado GOP regarding helping with this.

These recalls are limited to constituents in the districts of the rep, which makes sense. At my location in Douglas county, both of mine are R's so no need for recall here. My current recourse, aside from continuing the emails and attending the committee hearings, will be participating in any lawsuit after the fact.

I've reached out to others, gun owners, people in the industry in afflicted districts and have been met with apathy and defeatism, including the idea of the lawsuit if they pass will fail.

Between the 2 forums, James and Keith are doing a much better job of organizing efforts. I'm still willing to help anyone who needs it. My thinking is the first recall petitions should be active before the Senate votes.
