If they want to do backround checks on all purchases that's fine. Just eliminate on the 4437 form the spaces where the make of the gun, and the serial number is provided and that would be the proper way to do a "backround" check on the buyer. The only "check" that is really needed is whether the buyer is ok for a gun purchase or not. I'll bet if this was proposed, then we would expose the hoplophobes negative reaction to real check of the buyers history. The hue and cry would be something to see, and then everyone could see the real agenda of the gun grabbers, that of gun registration. Not public safety.

I think that all of us in the gun community know this already and the fact is that most people outside of this community don't pay attention to politics at all. Take my girlfriend for example. She is ignorant to anything political and don't ask me how, but is completely content with that. These people are sheep and just don't care as long as they can live their stupid lives. Who do you think believes all these false statements on guns and all these other topics. People that don't know or care to know any better. The MSM constantly tells them, entitlements are good and responsibility is bad and without looking into things they believe that it is true. How many times have I heard that the government paying for my new healthcare is awesome, but none of them look into it and see who is actually paying the bill. The problem then comes when people who don't pay attention vote. I'm not sure exposing any of the gun grabbers will do anything. If we had the ignorant masses mad we might have a shot, but honestly I'm sure most of them don't care what happens as long as facebook and twitter work.
I'm against any background checks outside of an FFL deal... The big issue here is not just the fact that someone is looking over your shoulder, or regulating your right to sell and buy private property. Name one FFL that's going to do a background check, for you to sell something to someone else, and they don't get a cut. Can't, can you. Everyone will charge to use their store as a front for the deal. I've even heard of some FFLs outright saying they won't do it, and the you have to sell your gun on consignment to them, then they'll sell it to the prospective buyer. I call bullshit. Leave it the way it is.

That's why they went the unconstitutional route and stated that FFLs MUST do the transfers for no more than $10. The state of Colorado is now forcing the sale of their product by third parties at a fixed cost which doesn't cover the cost of the work by the FFL. (e.g. logging in the bound book and storage of the forms for 20 yrs) Eff them.

I could live with the universal background check laws if they were as follows:
No information about the gun(s) purchased is part of the check, it's JUST a check to see if you're a known "prohibited person".
Zero information from the checks is kept after an approval is given.
CCW's can be used in lieu of checks.
Checks are free.
Checks delayed more than 72 hours are automatically approved.
None of these policies can ever be changed.
THIS is how the Brady Checks were supposed to be done (Colorado should be considered in violation of Federal Law since it does its own BG check system and keeps the records forever already).
I don't trust this or future governments to abide by such restrictions on their power so I oppose the BG checks no matter how many actual criminals it keeps disarmed (and since the vast majority of refusals are false positives its not like this really helps anyway).

I'm still a bit confused on the fee. From what I understand the language says that FFLs can't charge more than $10 and that goes to fund CBI.
So you have a $10 CBI fee but do you also have an FFL fee that they get to keep? I use a FFL that is run out of an Apple store (computer not fruit). They dont' sell anything (unless you consider their consignment business) firearms related.
Or are FFLs like this now regulated to $10 which they have to hand over completely to CO CBI?
I want to make sure I have the facts straight before I call a FUD a FUD.

As I understand it, that $10 goes to the FFL. There's another fee to CBI that is uncapped to cover "actual costs".
I have a better idea. No BCG at all, criminals don't use a BCG, why should law abiding citizens be forced under penalty of law to use a BCG. We're not doing anything wrong when we transfer a gun to another law abiding citizen. What business is it of the government's if I get a gun or not?

The CBI check is state mandated the 4473 is fed.
If you have a valid CCW or are a LEO you should not be required to submit to a background check.
If you decide to swap shotguns with a coworker, outside of a FFL without a background check, you should not need to worry about a felony conviction, prison, loss of rights, loss of employment, and a $5000 fine in addition to related fees for that. Such penalties should only be applied to straw purchasers reselling to known criminals.
We can all eloquently wax on about how we'd like it to be in a perfect world, but with the democrats controlling current politics in CO, they have the votes to do most anything they want at the moment and don't seem to be wasting any time doing just that. If one of them proposed outright registration, I doubt any amount of calling/emailing/Etc. would keep them from getting the votes they needed to enact that as well. Kinda sorta sucks don't it?!
I've called/emailed at a minimum of five times per day for the past month. I've donated more than I comfortably could to NRA/ILA, result: all four of the current bills easily passed. Although I'll continue to put up the good struggle, my optimism meter isn't reading well.

I would find a UBGC law less objectionable if it followed Zundfolge's advice but I'd still be against it. I shouldn't have to conduct a BGC on someone I have known personally for years or to gift a firearm to a family member or friend (as long as I know or can reasonably conclude they aren't a "prohibited person"). One of my Scouts asked about this last night and I told him it's no skin off my nose because I can afford the fee and live in town but why should someone in the rural parts of CO have to drive 50+ miles and pay a fee in order to sell a rifle or shotgun to his neighbor or grandson?

Because its the LAW. And you want to be a Law Abiding Citizen, right ? [ROFL1]
If they want to mandate universal background checks, they need to simplify it so you can just enter the purchaser's CO DL# into your smartphone and get an "accepted" or "declined" within 5 minutes.
