Felony theft for $13.50 in movie tickets?! [Eek2] Why not just give them the death penalty?

The married couple went to the movies Saturday night at a multiplex in Portage, Indiana, where they watched “Snitch,” starring Dwayne “The Rock” Johnson. When the action http://i.cdn.turner.com/dr/teg/tsg/release/sites/default/files/assets/harbinmugs.jpgflick ended, the Harbins exited theater #13 and headed into theater #15, where the zombie film “Warm Bodies” was about to start.
The Harbins, however, had not purchased $6.75 tickets to the second movie, which resulted in the duo’s arrest for felony theft, according to a Portage Police Department report (http://www.thesmokinggun.com/file/movie-theater-sneaks?page=0).
Two off-duty cops working security at the Portage 16 IMAX were standing outside theater #13 as “Snitch” was letting out. One officer reported alerting to Lendsey Harbin, 49, due to his “very colorful clothing, white vest, white dress pants, and a bright red shirt.” The second cop advised that he thought the Harbins had previously “attempted to sneak into movies without paying for the tickets.”
After the cops could not locate the Harbins in the hallway, they canvassed surrounding theaters and found the couple waiting for “Warm Bodies” to begin. After previews had ended and the movie started, the officers approached the Harbins and requested they exit the theater.
When asked for their ticket stubs, the Harbins came up empty. “I know we done wrong,” (http://www.thesmokinggun.com/file/movie-theater-sneaks?page=1) said Delilha Harbin, 40. The pair reportedly “advised they had snuck into movies at this movie complex 3 to 4 other times.” The Harbins, who live in nearby Gary, Indiana, also claimed they “were at a funeral all day and just were not thinking correctly.”
The duo was “taken into custody without incident” and transported to the Porter County jail, where they were booked on the felony count and later released on their own recognizance.

Those charges certainly do not fit the crime. I could see asking them to pay for tickets if not then to leave. Perhaps something is missing from the story, if not that is an excessive charge.

I looked up the shoplifting laws for Indiana, so it is at the discretion it appears of the prosecutor to pursue it as a felony or misdemeanor. While this isn't exactly shoplifting, I thought it was the same vein.
I think it would depend on their history, like prior arrests etc. but assuming they don't have priors a felony count seems extreme. Beyond that if they get say 2 years in jail how much is that going to cost the taxpayers. Hit them with a misdemeanor, fine em, assign them to community service and save a few thousand dollars in room and board.
Thats bullshit. At worst they should have to pay for the tickets and be banned from the theater
Stealing cable is a felony in some states. Or so I hear.

petty theft at best... but if we make it a felony then you cannot vote or own "baby killing fully automatic military style machine gun high capacity assault weapons"

Felony for $13.50...bulls**t. Yes, what they did was wrong. But not felony wrong. Capricious penalties like that do nothing to support the integrity of the legal system. If it has any integrity left...

The police always charge the highest possible crime ( For Statistics) :-), The DA will decide if charges are to be filed and or drop down to Misdemeanor or even possible petty theft. That is some funny Sh*t, dam cheap as date, should have just bought the tickets LMFAO. Sounded like he was dressed like a PIMP, according to his description by the police. Should have had $13.00 dollars to spare.

THIS is what is going in (and has been going on for decades).
Its an extension of this scene from Atlas Shrugged:

Add to that the idea of elevating the smallest misdemeanors to the level of felony and you'll have even those of us that claim to support the rights enumerated in the Constitution clamoring to strip most of the people of most of their rights.
Does anyone here honestly believe that these people deserve to lose their right to vote? Their right to defend their home from violent criminals?
They deserve to have to make restitution, pay a reasonable fine and maybe do a few evenings of public service and that's it.

When I was a kid, the cinemaplex consisted of one theater that showed the same movie over and over. So, not I never had the chance.
The cops should of made them pay for the movie tickets and another round of concessions. That would guarantee the couple wouldn't try that again.

Honestly, I could even see 14 days in the county... if they could prove repetitive intent.
maybe restitution, a fine, community service... but indiana has gone batshit crazy with the felony charge.

Me. Bread runs, joy riding, drag racing, brawling with the jocks, cigarettes and buying liquor, yes. Movies no.
Felony theft as mentioned start with high charges and plea bargain. Either way it cost more to prosecute then slap them on the wrist.
Really the only crime i see committed was the Clothing worn, good god, RED & White , in the winter OMG[ROFL3]
