An Iraq war veteran who said he acted on reflex when he shot another man during a daytime brawl has been sentenced to 90 days in jail and two years probation.
Twenty-four-year-old Matthew Moore pleaded guilty to felony menacing Friday in the Aug. 25, 2007, shooting of 25-year-old Leo Garcia. Moore had been charged with attempted murder.
Police said Moore shot Garcia in the chest and face after Garcia grabbed Moore's AK-47 and pointed it at some people. Police said Moore knew the AK-47 wasn't loaded.
Moore also has to attend anger-management classes, perform 60 hours of community service and pay restitution for Garcia's hospital bills.
Moore served with the 2nd Brigade Combat Team, 4th Infantry Division based at Fort Carson.
Story doesnt really say enough to make fair judgement, I think...doesnt say if Garcia and Moore knew each other, if Garcia was pointing it menacingly or just for fun (god knows people aint the smartest with guns).
