Eric Holder: Drone strikes against Americans on U.S. soil are legal

Attorney General Eric Holder can imagine a scenario in which it would be constitutional to carry out a drone strike against an American on American soil, he wrote in a letter to Sen. Rand Paul, R-Ky.

“It is possible, I suppose, to imagine an extraordinary circumstance in which it would be necessary and appropriate under the Constitution and applicable laws of the United States for the President to authorize the military to use lethal force within the territory of the United States,” Holder replied in a letter yesterday to Paul’s question about whether Obama “has the power to authorize lethal force, such as a drone strike, against a U.S. citizen on U.S. soil, and without trial.”

Paul condemned the idea. “The U.S. Attorney General’s refusal to rule out the possibility of drone strikes on American citizens and on American soil is more than frightening – it is an affront the Constitutional due process rights of all Americans,” he said in a statement.

The Federal Aviation Administration is looking into a report by an Alitalia pilot who said he saw a “small, unmanned or remote-controlled aircraft” on final approach to New York’s John F. Kennedy International Airport.
The Alitalia plane was on final approach about 1:15 p.m. Monday, when the pilot saw the unmanned aircraft approximately four to five miles southeast of the airport, the FAA said in a statement.

“We saw a drone, a drone aircraft,” the pilot can be heard telling the control tower on radio calls captured by the website LiveATC.net (http://www.liveatc.net/). Later in the recording another pilot reports a similar sighting.

The FAA is investigating the pilot’s claim and the FBI is taking a preliminary look into this incident. The Joint Terror Task Force is also investigating, a source familiar with the investigation told ABC News.
The unmanned aircraft was flying at an altitude of approximately 1,500 feet, but the pilot did not take evasive action and the Alitalia flight landed safely, according to the FAA.

When I read this... the first thing that came to mind was another Ruby Ridge type of incident, but this time it will go down as something along the lines of "survivalist/extremist home explodes due to unknown causes. Home/Compound appeared to have large cache of powder and other ordinance"... This does not give me a good feeling at all, and as I have told many it has nothing to do with Obama; I'd hate this decision from any president or his administration (past and present).

Maybe it wasn't such a good idea for us to move out of the city to the open prairie. At least in the a crowded metro area collateral damage may make them hesitate.

I don't know anything about the composition of the drones... I would think that the rotary-blade type affairs would be able to be disabled with birdshot, but what about other types? Would a skeet gun with some creative loading be able to down one?

they wont necessarily be hovering 50 feet or less above your location. they can be miles out. little chance of you hitting one that way.

Most of these drones fly so high you wouldn't even know they were up there. And that, plus the altitude at which they fly, makes it impossible to shoot them down with conventional rifles.
