Can an employer tell you if you park in their parking lot they have the right to search your car and you can be disciplined for having a firearm in your vehicle while it is in their parking lot? I thought your vehicle was considered an extension of your home in Colorado? Thanks for any help.

Technically, there's a lot of gray here. If you were aware of the policy and signed off on consent as a part of your employment contract, then you could potentially be fired if you do not allow them to search the vehicle. They do not have the power to "force" a search under any circumstances, but there may be direct and indirect consequences for refusing. Certain employers (.gov, railroads, etc.) may have additional authority under the law, but as a rule, private companies are allowed to dictate policy on private property, so as long as your vehicle is parked on their property, you must abide by their rules.

Aaaaargh. Your vehicle is not an extension of your home in Colorado.

That said, a private employer has no "right" to enter your car. But you don't have a "right" to carry a gun in your vehicle on private property either - but the employer's remedy is to fire you or withdraw permission for you to park your car on their property.

thanks, that's what I figured. I don't carry in my car... just didn't know how legal it was for them to say that.

An employer can fire you for a lot of things in Colorado. Bringing a firearm to work property against company policy, in most circumstances, is one of them.

You would not be hired by us if you did NOT have a gun in your car.

Unless of course you were a hot chick, but then again hot chicks that work with steel usually have a gun or 2.

This is SO wrong. There are several ways a police officer can search your car without a warrant. Same goes with employers on their property.

They can always make searches of vehicles a condition of employment that you can either agree to or not. And if your employer is the federal gov't, well...

If you get to the point where your employer is demanding to search your vehicle, you really need to be looking for your next gig anyway. $0.02

Colorado is at will work state. They can't make you unlock your car for them, but they can fire you for it and you have no recourse.

(Unless you're a homosexual, pre-opt transvestie, who is also a minority illegal immigrant who voted for Obama. Then you're ok)

And we should consider this bad. I know it is wishful thinking, but if everyone that did not agree with this crap walked out and shut down basic state and fed operations it might be a good thing!

There would be a lot of deluded, unemployed, former government workers.

If you are on someone else's property, you should respect their wishes. If you have property, other people should respect your wishes.

If you would like to change government policy, elect officials who will work toward making those changes a reality. Work toward making those changes yourself.

Can a private employer force you to allow them to search your car? No, but don't be surprised when they no longer employ you.

Be safe.

My company policy is that you must have a gun in your car. We just hired a new guy. He has thirty days to comply

I am not disputing that. My point is why would that be bad? Most of the people here agree that the .gov is bloated and cumbersome, and need to be trimmed. So leave and go into the private sector, vote with your feet just like you would at a private establishment. I am in no way bashing employees of the state/fed, but isn't this just another way to make more people dependent on the .gov and therefore control them? Can anyone tell me with a strait face that the more of the economy that is in the hands of bureaucrats is a good thing? This is why I am now and will always be private sector, and for many years the boss. I take the risks so that no one has control over me. Not being sheep is about more than just defending yourself, its free will. Food for thought.
