Student Provision?

So I spent the better part of this whole day trying to figure out my options...

I am a College student in Denver at DU from Washington State. I would like to purchase a new handgun(s) here while I'm at school, but at this point I retain my residency in Washington. In CO, visiting students are not required to obtain a CO drivers license to declare residency here though according to their website....

Is there any way I will be able to buy a handgun here in Denver without becoming a resident of the state?

If I don't get a CO license, can I purchase with a CO issued ID card?

What about online purchases...?

I hope you guys can help me out. I'm hoping to buys a couple handguns in the next month or so and I'm hoping I don't have to wait to travel back home to do it.

a CO ID is accepted for purchasing a firearm.

Are you paing in state tuition or out of state tuition?
Are you living in the dorms, or somewhere else?

Ask DMV. They may require you to surrender your drivers license if you get a Colorado License, and or ID. Not sure how they're doing that now.

Unless you are military on active duty orders, you will need to provide proof of residency, and a some form of Colorado ID to buy a gun here.

I'm pretty sure they will require him to surrender an out-of-state DL for an in-state DL. I don't know about state ID's, though.

I do know that there's something in the traffic code requiring drivers to obtain CO DL's immediately upon becoming residents. I don't think that provision excludes students, so much as it says that students who don't plan on becoming residents are not residents.

As for time periods...I moved here on 8-29 of my first year here, got my DL on 8-30 of that year, and bought my first handgun from a dealer on 9-3. There's no waiting period like there is for resident tuition or resident fishing licenses.

The dealer flat out messed up on that transaction. He should have seen the issue date on the drivers license. He will pay large fines if that is caught during a BATF audit. You must have proof of 90 day residency and a government issued ID with the correct and current address to buy a handgun. If the license is not at least 90 days old then you will need three consecutive months of untility bills with your name and address on them. That is of course unless you find a dealer that isn't paying attention. I was really careful with this when I was doing checks. The three BATF agents that came and visited every year were looking for extra income.

Interesting. I've heard that from time to time but never seen a statute or regulation or BATFE open letter cited. Do you have one?

It's in the regulations book. I no longer work for the FFL as of a few months ago, so I can't give you specific pages or numbers, but I doubt it's changed since then. We got yearly training from the BATF in our store. Two mistakes most commonly made by FFL's is not having the current address on the ID (in other words writing the current address on the back of the license does not suffice with the BATF), and the 90 day residency proof.

Thanks for the help so far guys. I think I'll just have to head into the DMV and see what they say.

I'm not paying either in-state or out-of-state tuition... I'm in graduate school so they don't differentiate. I have been living for over 90 days in a rented apartment off campus and pay all utilities and everything under my own name.

that shows the qualifications for new residents and it shows that students aren't required to get a license in CO if they're here for class... so the question is, will they let me have an CO ID card as well as my WA State license?

You don't have to have a CO ID to purchase a handgun. Many people have dual residency if you don't have a CO ID the FFL dealer will need to call CBI for the background check. The system will not let you enter an out of state ID on the web site.

All you have to have is a valid CO address and meet the 90 day residency requirement and your good to go.
