Quite a bit more in the article.Quote:
In the wee hours of the morning on September 13th, Air Force Sgt. Matt Pinkerton and his wife were entertaining guests at their home when an acquaintance of Mrs. Pinkerton’s came knocking. It was 2 AM. After being told to leave by Matt Pinkerton, who closed the door, Kendall Green decided that he’d kick it in and force his way into the home.
Matt Pinkerton, having armed himself with his Glock17 9mm prior to approaching the door, then proceeded to discharge two rounds into Green.
Green was subsequently killed in an obvious act of self defense.
But the story didn’t end there, as it should have.
The district attorney’s office has now filed second degree murder charges against Sgt. Pinkerton.
You may be asking yourself under what pretext?
According to the DA, Pinkerton exhibited “bizarre behavior” by grabbing his weapon when an unexpected knock came to his door at 2AM that morning. And, because he failed to call 9-1-1 between the time Green kicked in his door and rushed him, he has now been charged with murder by the state.
Should add, someone kicks in my door I'm not waiting and calling the cops first. Anyone that does is lacking in self preservation skills.
Thanks Merl.......and I agree with your comment.
Good shoot. Hope someone pulls their head out of their ass.
Assuming it's not a love triangle.
Sounds like the DA needs his pound of flesh and only one party is still alive to take it from at this point.
Maryland, home to the NSA! I guess we are safe here, unless some scumbag Colorado DA decides "Castle Doctrine" doesn't apply. Moral of the story is it is much better to have the police shoot the bad guy. I'm guessing this DA is behind this... http://msa.maryland.gov/msa/mdmanual.../msa16763.html
Glen Burnie, MD - I used to live there.
The wife denies cheating on her husband while he was in Korea. The deceased and the husband had one previous altercation prior to the shooting. Apparently the deceased wanted more than just a friendship with the wife.
You would like to think that two other witnesses and the damage to the door frame would be sufficient to keep the shooter from being charged, but this is the People's Republic of Maryland. They don't like guns in the hands of citizens and only the police get to shoot people and not get charged in Maryland.
I love the area but could never live there ever again.
I'd say that this scenario is unlikely under Colorado Law, but I would have said the same thing about a magazine ban a year ago...
1. Even if my castle law does not exist, I would still shoot to prevent the asshole from taking over my weapon.
2. I ll fight the dumbfvck DA with everything I have even if I have to go bankrupt over the thought of that asshole would do to my family if he wouldve gotten my gun.
