Need some help please

We have friends they are 75 and 80 respectively and had a bad car accident just as they were crossing the kansas border. They both have cracked vertibres in there backs and are hospitalized here in colorado springs. They had a gun in the car which was totaled and the gun is in lymon, I assume at the police department. It will be awhile before they can get out let alone try to drive again. Anyone here that can give me some advise on how to proceed to get the gun back down here. With all of the new laws I am sure I can't go pick it up. Any help anyone could offer would sure be appreciated. They seem to be worried about it and I would sure like to help them any way I could...Thanx

Where is the totaled car? Where was the gun in the car before the accident? That is the first place I would check.

There is no reason to believe the police handling the accident went looking for a gun in the car. If the police took the gun, it should be on an inventory and when your friends are able, they can recover the gun from the police. If the gun isn't in the car and the police don't have the gun, then your friends will need to file a theft/missing property report for their insurance.

As long as no one knows about the gun, it should still be there. If the tow company knows about the gun, it's probably gone. If that is the case, I'd call the police on the tow company. The tow company knows exactly who picked up the car. If there was no crime committed, police don't have anything to do with car; otherwise it would be in police impound. As I write this out, I feel like your best bet would be to have the owner (if possible) notify the police of the gun, their concerns, and if an officer is willing, have the officer make a call to the tow company about securing it or turning over to an officer. I don't know how well that would work, that is what I would try.

I have no idea where it was but it is now in police custody,,,,so am guessing they will just hold it until these folks are well enough to drive, was wondering if the police could send it through an ffl dealer or something. Might be best to just contact the police department that has the gun and ask them what is required. I assume every town has its own rules in dealing with such a matter on top of the state laws. They are old honest folks and for all I know they may have informed the police that it was in the car as they didn't want it stolen and end up in a bad persons hands....

Are either of your friends able to talk and contact the PD from the hospital, can you talk with them about that and find out if they can call? That would be the first step. Do they have any offspring here in Colorado? As pointed out it might be very difficult for a non-relative to collect personal property. Perhaps see what they are capable of doing as to calling on their own-someone from the hospital will be able to confirm with the PD that it's actually them calling, then go from there. They did fine by telling the officer on the scene. Once a car goes into storage or is totaled, no telling where the gun would end up. At least you know where it is and the police will have it on inventory. Wait for a weekday and give a call to the PD and ask them who can pick up the firearm for your friends. The PD may have to do some research and get back to you or they may just say that your friends are the only people who will be allowed to come pick up their property. Either way, the gun shouldn't be going anywhere and it doesn't sound like your friends are going to be needing the gun for a while, while they are recuperating.

As others said, maybe have the owners contact the police and see if they can give you authorization to retrieve the property for them. They might have to do some sort of power of attorney thing or something.

Probably just be easier in the long run to wait until the owner is well enough to make the trip to pick it up. Maybe you could drive him when he is well enough to travel.

I picked up a handgun from the police once that belonged to my grandfather. Wasn't a big deal. Told them who I was and how I was related to him. They took down my driver's license info, made me sign a form saying they released the property to me, and handed it over. Of course that was quite a few years ago and was in Texas.

Hope they both get to feeling better soon.

If they are already the owners of the gun can't the police just send it to them in the mail just like sending your gun off to a smith to have work done to it?
