I thought after Hurricane Katrina there was case law against gun confiscation. I could just be dreaming since I can't find anything on it. Checked google and a couple of forums. I went through several pages on here and I'm not seeing anything jump out at me. If there is any info on this please send it my way. I'm trying to compile a case law document.
You are remembering correctly. Gun confiscation, during an emergency, is actually now prohibited BY LAW (not just judicial case law) under the Vitter Amendment titled the "Disaster Recovery Personal Protection Act of 2006".
Specifically, the Vitter Amendment is "intended to prohibit the confiscation of legally possessed firearms during a disaster. Its provisions became law in the form of the Vitter Amendment to the Department of Homeland Security Appropriations Act, 2007."
