My wife and I were hit by a drunk this time last year. He crossed into our lane while looking for his cell phone on the floor. He had been drinking, smoking pot, and had heroin in his system all that day. It's not a fun experience and I'd be in prison for murder right now if he would have killed my wife.
It's very sad. I ride....and usually my wife with me. people don't care enough to think about their actions. I lost a good friend to a drunk driver. His name was Officer Bob Wilson, District 4 DPD. he was a good man and fellow veteran....RIP.
There are several stricter punishments that came out two years ago and are coming out this year...
The problem is money. If you pay for a good attorney (not that I don't think you should have one if you are arrested) then the chances are it gets thrown out. Luckily, our stops are usually done in front of a camera, most of the time, so the court room actually gets to see roadside maneuvers take place and hears actual statements such as "i'm drunk."
The other problem with repeat offenders is that they know EXACTLY how everything works and know what we have to do, with time frames, tests, advisements, and so on. They will work the system exactly in their favor.
For instance, they have two hours from time of contact to take a chemical test and we have been advised if they refuse we advise them of the consequences, however if they revoke their refusal we have to let them take a chemical test. A recent repeat offender revoked their refusal at the 1 hour and 50 minute mark. It takes at least 20 minutes to conduct an observation before allowing a breath test to be taken. So adding up the math you can see the breath test was taken outside the two hour mark. This got a good portion of the case thrown out, less charges, and said intoxicated party kept license and took several pleas in the court room.
That isn't too common and I don't want to turn this into a thread trying to figure out what is right or wrong with the DUI system and what cops do, but this is a fine example of stuff we run into daily with DUI's.
Sorry to hear that man. I have my endorsement but don't ride too much. This year I have noticed a huge increase in MC accidents in our jurisdiction and its got me nervous to go on the road on a Bike.
