Well, the facts are we don't know a lot of facts, except that we can be certain he committed acts of terrorism against the US by:
- overtly placing at least one bomb along the marathon route.
- detonated or assisted in the detonation of the bombs
- participated in felony murder (at a minimum) of the MIT officer
- attempted to kill numerous other police officers
- placed an untold number of civilians in mortal danger
- participated in a kidnapping, car-jacking and theft
- attempted to flee to avoid prosecution
- committed an unknown number of felony firearms and explosives offenses and other felonies
Sounds like he was an extremist to me. Maybe not to the extent of his brother but at this point that doesn't really matter. He did what he did and all of this nonsense about his rights as a US citizen might not apply depending on what Obama (or the DoJ under his direction and authority) decides his status to be: ie, enemy combatant or unlawful enemy combatant.
I've never been arrested & with the increased powers LE is being granted (ie. we're looking for a bad guy so everyone's constitutional rights go out the window) coupled with the increased frequency of LE abuse horror stories I'm not even sure I wouldn't run anymore.
