Also I try like hell to get 50% down on jobs. Doesn't always happen that way. Tom Marino says that anyone wanting 50% down must be fly by night. I say I don't want to finance your fucking project, and 50% usually covers all materials if someone does try to screw you. I had to file a lien once and got paid right away. What a pain in the ass that was. Let me correct myself....my wife filed the papers. I'd have probably let it go...or broke some legs.
Also I know a GC that was once chased around a jobsite by Tom with cameras asking why he's shady bla bla. This ex felon contractor gave Tom small pile of cash and Tom now recommends this same GC
Hmm it sounds like a large construction problem. If there is a loan/bank, there is a document called a disburser's statement that you can send to the bank or owner and they have to disburse checks jointly.
at a minimum file the mechanics lien even if you never foreclose on it, though for the amounts you are mentioning it would be worth it.
