Serious question: could Giffords pass a test of mental capacity that would qualify her to own a firearm?

Followup: if not, is she qualified to have her opinion considered by anyone?

If she has the mental capacity, then she's fair game. If she doesn't, she shouldn't be talking in the first place.

But if her mental capacity was diminished to that point you couldn't fault her for talking. Kind of a Catch-22.
