I would have to disagree but like you said the clothing rack is in the way, But if the guy is still alive and moving (on the ground or not) He is still a very real threat.
I watched it again and you can see the perp pick his weapon back up and come across pointing it in the general direction of the clerk.

going frame by frame the clerks second shot that " hits" the bad guy the muzzle flash is pure white and is about at his wrist.
