Speaking of this, I guess Colorado just passed a bill that makes it illegal for kids to not wear helmets while riding their bikes. They had something in there saying that boys had to wear a cup, but that got thrown out, I can only imagine why. As much as I would hate to have something happen to my kid because of some preventable accident, I would hate just as much to have the state not mind its own business and let me worry about my kid on my own. I'm so tired of these terrible nanny laws. Looks like we are late to the party as well...

That's actually a good question BigBear. Road bikes are supposed to adhere to the same right away stuff as other on road vehicles, but I've got no first hand experience with traffic violations.

If the kid is in your driveway, can you just tell the officer to fuck off and get the hell off your property? That's what any police officer deserves if they try to write you a ticket for not having a helmet on your 2 year-old in your own driveway. That might sound strongly worded, but officers have the option to not try and enforce bullshit nanny laws and the ones that do deserve to butt heads with civilians.
I agree. Selective enforcement is an option.
I guess the article states that the law is for public streets and places where the public has access to (the park, parking lots). I have a feeling that MOST officers absolutely loath all these new stupid laws that they are supposed to be enforcing. People complain about having such a litigious society, but constantly churning out more and more laws is only making the matter worse. Now when a kid gets hit by a car while riding his bike, is the family going to sue the city for not yanking the kid off the streets because he had no helmet? More laws = more liability = less personal responsibility.
