My fiance and I are on our way home around midnight lastnight, waiting for the red arrow to change. SLAM, what the hell was that? A drunk driver, plowed straight in to the back of us, at about 30-35 mph, is my guess. Made for a little longer night then we wanted, but the good thing is we are both ok. As for my little ladies car... Bummer.

Glad you are OK- Same thing happened to my Mrs and I in 2001. The asshat that hit us was 3 times the legal limit and on his 3rd DUI. We spent 4 years fighting with insurance companies.
Lawyer up and dont settle on ANYTHING until you have an attorney.
I know we all despise lawyers but now is when you need one.

Glad to hear you guys are okay. Don't take it lightly. My wife was rear ended Wednesday morning and she thought she was alright. Since late Thursday till now, actually sittng at an after hours doctors office writting this, she has had terrrible neck and back pain! Your body does weird things. Often times you'll feel fine for the first few hours after the accident because of all the adrenaline, then feel sore later. If you are hurting right away, then you should probably go get checked out. It is always a good idea to get checked out after an accident in my opinion. When I was an adjuster, I always told people to go get checked out as soon as they could if they were worried about anything. It is better safe than sorry.
Get to a Dr. or Chiropractor for the neck thing - immediately... trust me! You want to manage that asap... don't wait.
The lawyer thing isn't any good until you get further into the medical problems and lack of payment or insurance problems. I know a good one if you need reference. (denver)

So, a police report can be a great thing to have, but it can also be completely meaningless. With that said, I fully agree that in ANY accident, it is always the best idea to call the police and try to get a police report. This will prevent people from completely denying involvement in an auto accident. It sounds ridiculous, but people do that all the time. Car accidents suck.
EDIT: I really hope I'm not coming across rude, as I'm not trying to be. It's just that the police aren't in charge of deciding fault in auto accidents. They write down what people tell them, record any facts that are available, and that's it.

People would get so angry when I would tell them that the police don't decide. I liked to use the example that the other driver could have been ticketed for not wearing a seat belt, and even though they received a ticket, it doesn't always mean that they are at fault.

I was rear ended by a drunk driver that was actually stopped behind me, and let off the brakes, and hit me at about 5mph. Slow enough there was no damage at all to the car, but about 3 days later I'm begging my doctor for skelaxin to make the back spasms go away.Quote:

A lawyer won't really help you get more money. Lawyers get more money from the insurance company to pay themselves. If you are having a problem getting fair treatment from an insurance company, either threaten, or actually make a complaint to the DOI (Department of Insurance). Nothing will get an insurance company's attention and reaction faster, not even a lawyer.
When Gloria's sister and mother got t-boned by a drunk driver who ran a red light. Every single lawyer her sister called refused to take them on because the guy didn't have insurance, so there were no deep pockets to go after. They eventually found a lawyer, but they are still just as much shit out of luck as they were before.

Any update on how you and your wife are doing?
We are well. Went to the Dr. yesterday, all is good. Just a stiff neck. Now we wait, insurance is taking their time. They said my wife would have to wait possibly untill next Tuesday before she can get a retal car...unless we pay out of pocket for one now.
There is no reason that you shouldn't get a rental immediately. Unless of course you are still driving your car around and it doesn't go into the shop until Tuesday or something.
one of my good friends got hit a couple years ago, and felt fine for weeks. one day out of no where he got a really bad headache and started blacking out... nest thing he knows he is in the hospital with brain swelling and almost died. the doctors said it was directly caused by his accident. ill have to ask him again exactly how it happened. not trying to scare you, but you need to be carefull about that stuff. he did end up getting like $13,000.00 for pain and suffering.
To make things better, last night I reported my visit to the doctor to our ajuster. And this morning we had to switch ajusters, because of my injury report. Whichin return, has put more of a delay on my lady getting a vehicle. Lucky me.
