Kid is also correct in that if you have it before the first this is all academic which fits wonderfully with the thread topic.
That bold word above is the key and is the basis of legal wrangling. Sure it doesn't HAVE to be added but it CAN and that is the key. Just like a 33rd Glock mag doesn't HAVE to be loaded to 33rds but it can. Just because you have 15rds or less in it doesn't suddenly make it legal. Considering how easily the KSG can be switched between tubes versus how long it takes to stuff shells back into a single tube to equal the same round count (since reload time to subdue the assailant appears to be all these idiots are concerned with) I have a feeling this will not make the cut.

Showing another big problem with these laws. I think we are still ok but niether of us will know until this goes to court. To be clear though this what was signed into law:

(II) A FIXED, TUBULAR SHOTGUN MAGAZINE THAT HOLDS MORE THAN TWENTY-EIGHT INCHES OF SHOTGUN SHELLS, INCLUDING ANY EXTENSION DEVICE THAT IS ATTACHED TO THE MAGAZINE AND HOLDS ADDITIONAL SHOTGUN SHELLS; OR
(III) A NONTUBULAR, DETACHABLE MAGAZINE, BOX, DRUM, FEED STRIP, OR SIMILAR DEVICE THAT IS CAPABLE OF ACCEPTING MORE THAN EIGHT SHOTGUN SHELLS WHEN COMBINED WITH A FIXED MAGAZINE.

the KSG has neither a 28" tube, any extension attached to the tube or anything else that is capable of handling more than 8 shotgun shells of 3.5" length. That last part would require going back to the hearing for the 3.5" length but I was there and remember that being where the 28" comes from.

We "should" be good to go but only the courts will know for sure.. Shame we even have to have this discussion.

BTW: for all the stupidity they did not got the NY route and limit the number of bullets on the potential for what can be held. In NY you can only have 10rd mags and then only loaded to 7rds. Here we are only limited to 15rd mags but no limit on how much we put in them.

BUT, you are incorrect. 28" tube is not the criteria...it is "holds more than 28 inches". A 30" tube, with spring and follower is right on the edge. 29.5" tube, with follower and spring won't take more than 28" of shells. It is the summed length of the shells!
