    So I'm going to advertise my considerable ignorance here...

    BG has a gun and is threatening, teller pulls a gun, BG runs, teller shoots him as he's fleeing...
    I have absolutely no issues with that, BG got what he deserved, it stopped him from hurting someone else at a later date, however from a legal perspective was the teller GTG, no charges?

    Let's say the same deal happened in my house, I'm in fear for the lives of my family, I quickly produce a weapon and BG runs toward the door and I fire. I'll get hung, is that basically correct? I can't fire if he's fleeing?

    Take me to school...

    Actually yes, you are correct. You cannot shoot someone who is fleeing. Huge civil and criminal liability there. If they are retreating you are not allowed to fire. Best thing you can do is either call the police and provide a description, or order him to stop and hold him at gunpoint until LEOs arrive.

    I think the guy in the video was in the clear, because the BG was firing at him?? I'm with Robb. Need a lesson.

    Wasn't the clerk a CCW instructor? Or something like that? As I recall, he wasn't just a regular guy with a CCW. And I liked the dust raining down like snow! I do think he should have stayed closer to the downed BG, instead of roaming all over the office. I understand the adrenaline thing though.

    Yeah, if he's firing I don't think that counts as fleeing. You're still in danger and under threat at that point. Now if he dropped the weapon and ran that might be different.

    it says in the video description on youtube that the teller had no charges filed against him, and the bad guy amazingly survived(and went to prison).


    As other guys said already, (and to the best of my knowledge) under normal circumstances if a guy is fleeing away from you, it is a no-no to engage, but since bad-guy was firing back as he was running away, that gives the teller the go-ahead to shoot him (and not get prosecuted).

    I wonder what caliber he was using? If it was anything less than a 45, it's a good commercial for the reasons one would want to own a 45.

    I have talked with the person who is the CCW in the video through another forum. The mom and child were much farther away in real time than they looked in the video. No charges were pressed and the cops actually told him good job.
