The problem isn't with fires started because the grill was left unattended while cooking, the problem with charcoal is that AFTER you finish cooking the coals are still hot enough to start a fire for quite a while. With gas or propane you shut the grill off when you're done.
As for grilling with charcoal during a burn ban, I figure if you're in your own back yard you're not likely to get caught ... unless you start a fire then expect to get raked over the coals yourself.
