i dont think its because he had a fatal accident it is because he was driving in a negligent manner that could have been prevented. he is being punished for his negligence

Im guessing that phone records show when the text was sent, and maybe if that is within 30 seconds of when the accident happened they could prove that was the cause?

if it's something like that, how do they figure the time that it takes to write a text?

did he admit to it? or maybe they found his phone on the passanger seat/floor/somewhere in the car after the accident with a half writen message open?
