Simplistically, yes. Most Failure To Appear (FTA) warrants are booked into the jail (specifically in Arapahoe County) as a Fugitive Of Justice (FOJ) charge. However, as mentioned many, many times here, the form is a federal form and local DA's will not charge on it as it is a federal form and the AUSA's will not charge on it due to not meeting any charging threshold they have.
He failed to appear to court to answer for a summons of Careless Driving, Driving Without a Valid License and No Proof of Insurance. He was scheduled to appear in court and he did not do so. He was probably one of literally hundreds that also didn't appear for their tickets that week, that the judge signed a bench warrant for. The bench warrants are entered into CCIC/NCIC by the court clerks and are not seen by the Arapahoe County Sheriff's office at all. Also, the ticket is in his full name, which I'm guessing most don't know and it wouldn't have rang any bells going through the court process.
So, the idea that they knew he had a warrant and knew where he worked and should have arrested him at Dove Valley isn't a valid thought.
When he attempted to purchase a firearm, the warrant was observed and the local law enforcement was contacted by the CBI. He was arrested, booked and posted bond like any other person in that situation (although I am guessing at a much faster pace). The question I would have on this is, on his ticket he had a Texas driver's license and was ticketed for not having a valid driver's license, which could have been because he lives in Colorado, but still had a Texas DL, which the law requires you to change within 30 days of becoming a resident. Did he get a Colorado DL in between the time he was stopped and the time he tried to buy the firearm, or was he attempting to use his Texas DL to buy?
