    Default ESIS Insurance: A Workers Comp Nightmare

    OK...mostly I just need to vent about this insurance company.

    I fell at work in Feb. Workers Comp claim for injuries were denied by the insurance carrier, ESIS. Hired an atty, spent 5 months trying to get the insurance to pay. They finally issued an Admission of Liability and I had the surgery I needed on my shoulder last Fri. That all went well and I'm now on the road to recovery. Up until yesterday I hadn't received a dime in workers comp benefits. Finally got paid yesterday...several thousand dollars in back pay. Got a call today from my bank that the check bounced. WTF?

    My employer has been fine through all this but there's little they can do. I called my boss today re: the bounced check. He was shocked. Join the club.

    Anyone else have a workers comp horror story?

    My wife works for a workcomp defense law firm, the stories she has are amazing, from both sides.

    In many ways, insurance is a Group Buy gone wrong.

    Are you able to get the insurance company to reimburse your atty expenses? I'm guessing they didn't bounce that check. Your atty is where I would start the process.

    Sorry this happening to you. I'm glad to hear you are on the mend.

    Apparently WC only reimburses atty fees if it's ordered by the court after a hearing. ESIS knew they were gonna lose the hearing so they stipulated the day before. I guess that's how they avoid paying a lot of things. The statutes definitely don't favor the worker.

    I personally have never had a worker's comp situation but some of my clients have. The general theme seems to be "we can wait you out" where you just go away or take a low settlement since the bills don't stop coming in.

    A good friend had recently the same kind of problem. He and his attorney sued in small claim court for 4 or 5 different claim. he was awarded pay, and medical bill, and some kind of punitive damage (I do not have all the details, sorry). His lawyer told him that it was easier to sue in small court claim, than anything else since his total claim were less than 100K.

    I have experience with workers comp. You're likely to find them a pain in your ass for then next couple of years.

    That's sad, what a bunch of jerkoffs. Sorry you went through all that crap only to have to fight some more.
