i got pulled over for a DUI several years ago. the first mistake i made was believing that i should be honest. when asked if i had any weapons in the car, i replied yes. a .45 under the center seat. i was cited for DUI, as well as possession while intoxicated. i was more concerned about the possession while intoxicated charge. i own class 3's and guns are a big part of my life. i got that charge dropped and plead to a straight up DUI. i made sure that in the agreement, that i would have my property returned. they were real jerks about it when i went to get my gun from the state patrol. he even said that i wasnt allowed to open the case until i was off of state property.
i learned several things in this case. mostly from a friend that is a sheriff's deputy.
1. in colorado your vehicle is an extension of your home.
2. you dont need a concealed carry permit to have a concealed weapon in your own home.
3. there is an exemption to the posession while intoxicated law when you are in your own home (otherwise everyone who has a beer at home, and owns a gun would be in violation).
4. cops are very ignorant of laws in general, especially gun laws.
i am not an attorney, i am not offering advice, just personal experience and belief. however, i believe that any good attorney that knows anything about gun laws can successfully fight the charge of carrying without a permit and probably possession while intoxicated.
i have been told by a cop that i trust (only one) that you are legal without a permit until you step out of your car.
good luck fighting this to whomever it is. the judges, prosecutors, and cops are all stacked against you. and remember this, YOU CANT TRUST ANY OF THEM TO TELL THE TRUTH, TO ADHERE TO THE LAW, OR TO TREAT YOU WITH RESPECT. it may happen, but it is not the norm.
no disrespect is intended to any LEO's on this site, but with cops trust has to be earned.
This was done and over with a long time ago. I think the alcohol part was dropped and he was just charged with carrying without a permit. It is like a class 2 misdemeanor. I think he is on probation for a year or something as well.

Thanks for sharing your story. Below is a great site on our rights as citizens. I think this should be taught in our school systems, as many do not understand what their rights are when they have an encounter with the police.
I believe in your situation (I could be wrong), you did not have to consent to a search of your vehicle.

i hope i am wrong, but once you are arrested, your vehicle can then be searched. in my case i assumed they would search and wanted to be honest in case they found the pistol. i should have declined to answer the question entirely. had i said no and they found it, it probably wouldnt have mattered that i lied. but there is a great possibility that they would NOT have found it, there is the possibility that they didnt even search the vehicle.
i have a friend that is in law enforcement, and because i trust him and believe that he is a good person, i translated that to all cops. that was a BIG mistake.
those videos are very good, do not ever talk to a cop. even when you are a victim of a crime, your words are distorted. cops are people, and most people hear what they want to hear, they add little details that werent there, or they fail to remember your exact words. it has happened to me when i was the victim in an assault, i was treated like the criminal. my oral statements were not recorded, and were taken out of context. bottom line is you cant trust anyone to accurately remember what was said, and NO ONE is looking out for you, except YOU.
