    Colorado doesn't have an inadequacy of water, we just don't store enough of it. Might kill some 'special' mouse or something making a reservoir.

    The law of prior appropriation has a lot more to do with it. We do not own but a very small percentage of the water that originates from our state. If we dam it up and allow evaporation to happen we have in affect been held accountable for that missing water owed down stream. Also the water we have stored is not ours to have and is owed down stream. Water rights are are tricky in the western states because it is the most demanded commodity.

    So if Colorado doesn't own much of the water that originates here then can we sue it's rightful owners for not preventing THEIR water from damaging our property?

    Maybe we should hold California responsible for the damage.
