    Default Form 1 question

    Before I send in two Form 1s, I have a question about length and caliber.

    On question 4 c, e & f, what if you plan on using a lower with multiple uppers? The uppers would be of differing lengths and calibers.

    I currently have two forms 1s ready to go for the two lowers. I have one upper with a 16 inch barrel I plan on using occasionally on them. But I will be building other uppers, a 10.5" 5.56; and an undetermined length 30 caliber. Maybe others, short or 16"+ inch and calibers that would work on the AR-15 platform.

    If the lowers and uppers are reconfigured/recombined what would happen if it doesn't match the Form 1? Is having a SBR stamp enough? Is there something else I should submit with the Form 1 to indicate my intentions for modular rifles?

    Others will chime in as well. Pic one upper, the shortest barrel length, and send that length in on the form. You can swap uppers whenever as long as you have the original upper that can be put on that matches the one listed on the original form one. Make sense? At leas that is my understanding.

    Go with the shortest. it isn't multiple choice. I always list specs for a 7.5" bbl .

    Not to hijack the thread, but do you build the upper BEFORE you apply or after you get the approval? What if something (availability, etc) changes between your intent on the form and the actual implementation a year later when you get approval?

    By the law you can't have the upper without the stamp. You can build the upper and give it to someone else that doesn't have a lower or a rifle that it will fit on unless that person has a Form 1 SBR stamp. You can always build it as a pistol and then make it an SBR once the stamp arrives. Also if you change things that don't jive with what the original Form 1 says you will be in violation. You can always build different uppers for the SBR as long as you keep the original upper.

    Doesn't this contradict another thread that says SBR is SBR and once on a form 1 any length is permissible?

    This makes me think I should buy all the parts before I submit the form 1, since know one knows what Mustapha Mond will do by the time it gets approved . If I leave them all in boxes and don't even look at one with a tool in hand is that still constructive intent? I DO like the idea of "pistol" upper, but if I don't have a "pistol" lower built does that still work?

    This also opens the can of "what is a pistol" worms that I also haven't got my head wrapped around...AFAIK the lower was listed as "other" when purchased and a stock was never installed...

    I've already pinged NFAGuy on most of this, we'll see what the resident guru thinks.

    Just build/buy a AR pistol and the problem is solved! Plus you have something to shoot, and work out the kinks on

    Just a reminder - from all my research, everything I have seen posted says that you have to start with a stripped receiver that has never BEEN built from the factory as a rifle to build your pistol lower. Can never have been registered as a rifle. Get a stripped lower, get it engraved, make sure the engraving is correct then submit your Form 1 with that serial number. You can then build the lower as a pistol with a pistol buffer and attach your upper with a <16" barrel and it is a pistol. Do NOT have "spare parts" to attach a rifle stock at this point and just wait till you get your approved Form 1 stamp back then it can get a rifle stock into an SBR. I assume if I mis quoted ANYTHING, there are enough members that will correct me but I am pretty confident this is correct (well I HOPE it is as that is exactly what I did).
