Default $999 fine/1 year in jail if your weed smoke bothers neighbors.

This is getting fun now! So even if you are on your property, doing something that's legal, you could get a fine/jail time if your smoke lofts over your fence and bothers your neighbor. Oh yeah, you also wouldn't be able to do it on your front porch where it's in the view of the public.

So my 4 month old and I shouldn't have a problem being affected by weed smoke? Hell the neighbors cig smoke below us is bad enough.

    I find this interesting

Mark Silverstein, legal director for American Civil Liberties Union of Colorado, called the ordinance a "tremendous overreach, ill-advised, unnecessary and unconstitutional."

Last time I looked at the constitution I didn't see anything referenced to smoking pot. I wouldn't even call it a right. It's more of a privilege. Just entertaining how the ACLU cares so much about that.

The constitutionality argument will be based on vagueness. Its a pretty good argument against the ordinance actually. Denver City Council is astonishingly incompetent.

What else do you do that bothers your neighbors?

Are your nosy neighbors who peeked your window going to be bothered by you cleaning a fiream? I wonder what the penalty for that would be?

This is bad law and sets an awful precedence for more government intrusion, not just on the dopers but on every single person.

So I guess it's ok to ban things on private property, even when its going to be legal? I know it's currently illegal for the majority but this isn't going to be negated after January 1.

"It would also prohibit smoking on private property if it is visible to the public, such as on a front porch or in a car, or if the odor of pot could be detected from a neighboring property."

Someone can't smoke a joint in their private backyard or on their own porch? While we're at it, let's apply this rule across the board then. No loud music past 10 pm. No cigarette smoking. No drinking a beer on your front porch or doing anything else that may bother your neighbor. I don't smoke weed but this is ridiculous.

You failed to answer my question, is it okay for my 4 month old to inhale the neighbors marijuana?

I think the law regarding not being able to smoke where it is visible to the public is ridiculous, but as soon as it starts negatively affecting my family and I, it's a problem, private property or not.

... but are they threatening to file child abuse charges if you smoke at home like they do with tobacco?
