Default Florida Police Use Warrantless Cell Phone Tracking, Claim Nondisclosure Agreements With Vendor

http://www.wired.com/threatlevel/2014/03/stingray/ Police in Florida have offered a startling excuse for having used a controversial “stingray” cell phone tracking gadget 200 times without ever telling a judge: the device’s manufacturer made them sign a non-disclosure agreement that they say prevented them from telling the courts.

Bad precedence if this goes the wrong way, nondisclosure agreements could end up precluding 4th amendment rights.

The NDA is there to prevent technology disclosure to other companies or competition. Has Nothing to do with the court. Saying it prevented them from getting a warrant is pretty far fetched.

Any NDA preventing them from telling the court precisely how evidence was gathered should also prevent them from using said evidence in the prosecution.

What is my joy if all hands, even the unclean, can reach into it? What is my wisdom, if even the fools can dictate to me? What is my freedom, if all creatures, even the botched and impotent, are my masters? What is my life, if I am but to bow, to agree and to obey?

Their argument will get them nowhere. Plus judges like their power and won't be happy with this.....
