    I don't believe they have to pay for a rental vehicle unless you actually use one.

    By CRS 10-1-109, 10-3-1110, 10-4601.5 and 10-4-639 they have to pay for the "Direct Loss"

    "Direct loss" is "cost to repair"
    Cost to repair is the repair of the vehicle, towing and storage. I believe rental vehicle is a consequential loss and they do not have to pay that unless you use one.

    Consequential loss
    is considered an indirect loss (as compared to losses from the direct damage).

    So I really wanted to know if they had to pay you for a rental vehicle if you cash out on a claim so I called the Division of Insurance.
    They said "no" an insured company does not have to pay for a rental vehicle or loss of use to a claimant on a 3rd party loss unless the claimant actually uses a rental or the vehicle is not drivable.

    Looks like I'll be getting a rental vehicle then while I work on it or get stuff done to it. I think they quoted 5 days so that should work.

    They usually have a person who follows up with the shop on the repair to make sure everything is being repaired on schedule. Be aware of that, as once they find out YOU are the shop, they won't extend the rental if the repair goes long. Shouldn't be a big deal for you some you are just looking for the money anyway.

    I think they estimated 5 days so I'll just keep the car that long. I have other vehicles but I'll keep the miles off them while I get this thing fixed
