    Default Moving with a silencer

    Does anyone know of an ATF requirement that relates to moving a silencer permanently out of state? Form 5320.20 does not seem to address silencers specifically but maybe I'm missing something in the fine print range.

    You are not required to notify them in advance of the move or obtain permission (via 5320.20). ATF does ask that you notify them of a permanent change of storage address to help them keep the NFRTR accurate, but they cannot compel you to do so.

    Easiest way to do it if you want to is to file a 5320.20 even on suppressors and AOWs, ticking the box indicating that it's a permanent move.

    I was just pointed to the definitions section of a Form 4 by someone opposing my opinion. Under "1. Definitions c. Firearms (7) a muffler or silencer for any firearm whether or not such firearm is included within this definition"

    NFA laws are a damn headache!

    I can tell you de-facto that when I moved here from Florida, I simply listed all of my NFA stuff on a couple 5320s, including my silencers. Worked for me, worked for the ATF.

    If all you have is suppressors, then it's just an address change--as others have said, no prior permission to transport is required.

    By policy (in other words, not in any law I can find) the ATF asks that you use Form 5320.20 to notify them of an address change. I realize this contradicts some of the Form 4 printed instructions and some advice I was giving to clients a couple of years ago. I started to argue this point with the ATF about a year ago and then realized arguing was a dumb idea on at least a couple of levels.

    Google "ATF Form 5320.20" and I'm sure you won't have any trouble finding it.
