Re: Your Violation of the 1974 Privacy Act, Federal Civil Rights Law, and the
U.S. Constitution

Dear Mr. President:

You have recently asked supporters of your health care reform initiative to tell the White House of any criticism of that initiative and further to tell you who are the authors of it.

You have even created an e-mail account, flag@whitehouse.gov, for your snitches.

I would think you, a lawyer, would know that this scheme violates the 1974 Privacy Act, 18 USC 241, 18 USC 242, and the First Amendment.

You are entitled to your opinion; other Americans are entitled to theirs. What you do not have the right to do, under federal law and under the United States Constitution, is use your office to intimidate freedom of speech, freedom of assembly, and freedom to petition the government for a redress of grievances. Your collection of data about your health care critics infringes upon this freedom, within the clear meaning of the First Amendment.

If this would otherwise be unclear to you or anyone else, the Privacy Act of 1974, which was spawned by Richard Nixon’s “Enemies List,” removes any doubt.

This is not the first time you have done something like this. During the 2008 Presidential campaign, your operatives in Missouri threatened to prosecute anyone who ran campaign ads you did not like under the state’s truth in advertising law. That stopped when certain state officials pointed out to you the illegality and unconstitutionality of the stunt.

So, either you and your Administration announce by five o’clock p.m. this coming Tuesday, August 11, that you all will cease and desist this illegal activity, or I and others will file a federal declaratory judgment action under 28 USC 2201 and 42 USC 1983 against you to stop your illegal, unconstitutional assault upon liberty, the Constitution, and law-abiding citizens.

I would love to see that. these .gov idiots need to hear about how 90% of the country does NOT want this health care reform.
he is on an agenda, wants to say HE did it and HE saved america from its health care problems but this will only make them worse.

I think all our elected officials need to be cleaned out and get some new ones in there. early retirement is due.

senators need to be term limited, our speaker of the house especially needs to be term limited and the president of the united states needs to be term limited to 1 (yes ONE) term.

in just a short while he will waste more time trying to get re-elected for the next 4 instead of focusing on the country. That needs to be the focus, on the country, what to do about the problems we are dealing with...NOT whose ass he can kiss to keep the job for the next 4 years.

Nice letter. I think he is indoctrinated with liberal ideas and therefore to old to learn anything new. He hangs out with antique liberals from the long dead 60's and is still pushing the same ideas from that time. He looks at these letters like anything that he doesn't agree with, complete disregard and contempt until he is forced to deal with it.
